THE DOS EQUIS DOS MILLION BRACKET CHALLENGE CONTEST
(“CONTEST”) IS OPEN ONLY TO LEGAL RESIDENTS OF THE (50) UNITED STATES AND
DISTRICT OF COLUMBIA WHO ARE TWENTY-ONE (21) YEARS OF AGE OR OLDER AS OF DATE
OF ENTRY. CONTEST IS GOVERNED EXCLUSIVELY
BY THE LAWS OF THE UNITED STATES.
BY ENTERING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A BINDING
CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS
CONTRACT INCLUDES CERTAIN RELEASES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND
REMEDIES, INCLUDING A WAIVER OF YOUR RIGHT TO A TRIAL BY JURY.
1. ELIGIBILITY:
The Contest is open to all legal residents of
the (50) United States and D.C. who are 21 years of age and older at time of
entry, except as set forth below.
Notwithstanding the foregoing, the following individuals
and members of their families (parents, grandparents, children, siblings, spouses)
and immediate household members (whether related or not) are not eligible for participation:
employees, officers, and directors of HEINEKEN USA Inc. dba Cervezas Mexicanas (“Sponsor”), Million Dollar Media (“Contest
Administrator”) and their parent, subsidiary, and affiliated companies,
alcoholic beverage suppliers, wholesalers, distributors, and importers,
alcoholic beverage retailers, and Sponsor’s advertising and promotional
agencies. All federal, state, and local regulations apply.
2. START/END
DATES:
Registration begins at 12:01 a.m. Eastern Time
(ET) on 1/31/20 and ends at 12:00 p.m. (noon) ET on 3/19/20, prior to tipoff of the first game in
the 2020 Men’s College Basketball Tournament (the “Designated Tournament”) which
will take place between 3/19/2020 – 4/6/2020
with the Semi-Final and Championship games to be held in Atlanta, GA.
3. HOW TO
ENTER AND SUBMIT YOUR BRACKET PREDICTION:
There are two (2) ways to enter the Contest: (a)
via SMS or (b) on the Internet.
(a)
SMS Entry: Submit an SMS entry
from your mobile device (“Mobile Device”) by texting ‘XXBRACKET’ to 77000. You
will receive a return text message providing a link to www.DosEquis.com/Bracket. Click the link to
visit the site and follow the on-screen instructions to enter the Contest and
submit your bracket predictions (“Bracket Predictions”) to participate in the
Bracket Challenge (see below). Carrier’s standard messaging and data rates
apply. All SMS entries must be submitted by 12:00 p.m. (noon) ET on 3/19/20.
(b) Internet
Entry:
To submit an Internet entry directly online (without sending a text), visit www.DosEquis.com/Bracket and follow the
on-screen entry instructions to be entered into the Contest and submit your bracket
predictions (“Bracket Predictions”) to participate in the Bracket Challenge
(see below). Normal time rates, if any,
charged by Internet service provider will apply. All Internet entries must be
submitted by 12:00 p.m. (noon) ET on 3/19/20.
NOTE: Limit one (1)
entry per person regardless of method of entry.
STEP 1: Registration: You may register any
time between 12:01 a.m. ET on 1/31/20 and 12:00 p.m. (noon) ET on 3/19/20.
STEP 2: Bracket Predictions: All Bracket Predictions
must be completed, submitted and SAVED by registered participants between 6:00 p.m. ET on 3/15/20 once the Designated Tournament team
selections have been announced, and 3/19/20 at 12:00 p.m. (noon) ET, prior to
tip off of the first game in the 2020 Men’s College Basketball Tournament (the
“Designated Tournament”). All previously registered and newly registering
participants must fully complete the provided online Bracket Prediction form on
the Edit/Update Picks page of the Contest website by not later than 12:00 p.m.
(noon) ET on 3/19/20.
Notes: 1. Eligible entrants
may submit bracket pick selections prior to 3/15/20; however, participating
teams and game match-ups will not be publicly available until 3/15/20.
2. Play-in game byes: The play-in games
on 3/17/20 and 3/18/20 are byes, and are not part of the bracket prediction
challenge.
STEP 3: Tie-Breaker: Each registered participant
will also be required to submit and SAVE their prediction of the Total Cumulative Points to be scored in
the Championship Game of the Designated Tournament scheduled to be played on 4/6/20
by no later than 12:00 p.m. (noon) ET on 3/19/20. Any registered
participant who fails to complete the Total Cumulative Points ‘tie-break’
prediction will be assigned a point total of zero (0) cumulative points for the
Championship Game.
IMPORTANT –
Save Picks: Participants are required to click the ‘Save Picks’
button on the Contest website to save their Bracket Prediction selections,
cumulative points prediction, and/or any updates to their predictions. Any
changes or predictions made without clicking the ‘Save Picks’ button will not
be saved or recognized.
All completed Bracket Prediction
entries must be submitted, saved, and received
by 12:00 p.m. (noon) ET on 3/19/20 in order to be eligible
to participate or claim any prize. Any
registered participant who fails to fully or correctly complete the online
registration form, or fully and correctly complete the required Bracket
Prediction for all sixty-three (63) games in the Designated Tournament (and save
their picks) will be ineligible to claim the grand prize (see below). Any Bracket Prediction not received by the deadline of
12:00 p.m. (noon) ET on 3/19/20 for any reason including, but not limited to transmission
error, internet problems, equipment or website malfunction, human or
programming error, internet traffic or errors caused by viruses or hackers will
be disqualified. Sponsor is not responsible for any delays or difficulty in
receipt of a registered participant’s Bracket Prediction.
Incomplete entries or Bracket
Prediction submissions will be disqualified. Sponsor is not responsible for
lost, late, misdirected, incomplete, invalid, unintelligible, or damaged
entries, or for entries submitted in a manner that is not expressly allowed
under these rules, or for any entry not submitted or
received due to any technical error or failure, unauthorized human
intervention, inaccurate capture or mis-entry of any required information, or
the failure to capture any such information, effects of hackers or failure of
any electronic equipment, computer or cellular transmissions and/or network
connections; all of which will be disqualified.
Scoring – Bracket Points: Each registered participant
who has successfully completed the online registration and Bracket Prediction
as required by these Official Rules will receive one (1) point for each of the sixty-three
(63) games for which they have correctly predicted the winning team. Incorrect
predictions will not receive any points. The maximum point total for correctly
predicting the winning team in every game played during the Designated Tournament
is sixty-three (63) points. At the completion of the Designated Tournament,
each eligible bracket prediction received will be compared to the actual
bracket outcome.
In order for the grand
prize to be awarded, a registered participant must correctly predict the winner
of all sixty-three (63) games in the Designated Tournament, thereby scoring a
perfect sixty-three (63) points. If no one correctly predicts the winner of
all sixty-three (63) games, the Grand
Prize will NOT be awarded.

NOTE: For purposes of clarity, if any game(s) are
cancelled, forfeited, or indefinitely suspended for any reason, and fewer than
(63) games are played in the designated tournament, then no entrant shall be
able to correctly predict the winner of all (63) games in the designated Men’s
College Basketball Tournament, as required to claim the grand prize. As a result of any such cancellations, forfeits
or indefinite game suspensions, there shall be no (63) game perfect brackets,
and no opportunity to claim the $2,000,000 40-year annuity grand prize, and no
grand prize or alternate substitute prize or compensation will be available for
award in the contest. Any eligible
contestant who has correctly predicted every game played in the tournament as
of the date of any such cancellation(s), forfeit(s) or indefinite
suspension(s), but fewer than all scheduled (63) games for any reason, shall
not be awarded and shall have no opportunity to claim the grand prize.
4. GRAND PRIZE:
All prize details are at Sponsor’s sole discretion. No part
of any prize includes any alcoholic beverages. Prizes are not transferable. No
substitutions of prize by winner(s), if any, are allowed.
A.
Grand Prize (1):
One (1) grand prize will be awarded only if an eligible participant
correctly predicts the winner of all sixty-three (63) games in the Designated
Tournament. He/she will then be eligible to claim the grand prize subject to
verification of compliance with these official rules, and subject to the terms
below in the event of more than one winning submission. The grand prize consists
of a $2,000,000 forty (40) year annuity, awarded in the form of $50,000 cash
per year for forty (40) years without interest. The initial $50,000 payment
will be awarded within approximately thirty (30) days of receipt of all
required paperwork. Each subsequent payment thereafter shall occur on or about
the anniversary date of the first payment for the next thirty-nine (39) years. No
current cash value of the annuity prize award will be available.
NOTE: In
the event there is not an eligible participant who correctly predicts the
winner of all sixty-three (63) games in the Designated Tournament, as required
by these Official Rules, then the Grand
Prize will NOT be awarded.
In the event of
multiple grand prize winning entries, the cash value
of the grand prize will be evenly distributed among the eligible winning participants
(i.e. if there are two eligible participants with a grand prize winning bracket
prediction, each participant shall be awarded $25,000 cash per year for forty
(40) years). If no eligible participant successfully
meets the grand prize winning requirements, then the
grand prize will NOT be awarded.
All expenses and travel costs incurred as a result of
seeking or winning a prize are the sole responsibility of winner. Any expenses
or costs not expressly stated in the description of the prize above are the
sole responsibility of winner.
All federal, state, and
local taxes, fees, and surcharges on any prize are the sole responsibility of
winner of the prize. Winners of prizes with a value of $600 or more will be
issued an IRS Form 1099-MISC early in the year following the year in which
prize was awarded for filing with his/her federal and state tax returns.
Sponsor complies with all tax reporting requirements. The amount of any tax
liability will vary depending on winner’s tax bracket.
5. DETERMINATION OF WINNERS, NOTIFICATION,
AND VERIFICATION:
Potential winner(s) of the Grand Prize, if any, will be determined
following the conclusion of the Designated Tournament on or about 4/7/20. Determination
of any prize winner(s), which shall be based upon scoring results and require
an eligible entrant to have corrected predicted the winner of all sixty-three
(63) games in the Designated Tournament, will be conducted by Sponsor or its
appointed agent, and all decisions are final. Potential winner(s), if any, will
be contacted by telephone. If any potential winner cannot be reached within five
(5) days of first notification attempt, if any prize or prize notification is
returned as undeliverable, if any potential winner rejects his/her prize, or in
the event of noncompliance with these Official Rules, such prize will be
forfeited and an alternate winner will be selected from among all remaining
eligible entries. Upon forfeiture of any prize, no compensation will be given.
Potential winner(s), if any, will be required to sign and
return, where legal, an Affidavit of Eligibility and Liability/Publicity
Release within five (5) days of notification that he/she is a potential winner.
No potential winner, if any, will be an official winner
until any required paperwork has been returned and eligibility has been
formally verified by Sponsor. If any potential winner fails to comply with these
Official Rules and/or to submit the required documentation within the designated
time period, he/she will be automatically disqualified and no compensation will
be given.
6. LICENSE AND RELEASE:
Participation in the Contest and acceptance of prize
constitute winner’s permission for Sponsor or its agents to photograph, film,
and record each winner and to use his/her name, address (city and state),
likeness, photograph, voice, biographical information, and/or any statements made
by each winner regarding the Contest or Sponsor for purposes of trade, publicity,
or promotion without notice or additional compensation, except where prohibited
by law. By participating and/or accepting a prize, entrants, and winners,
acknowledge and agree to release and hold harmless Sponsor, Sponsor’s advertising
and promotional agencies, and their respective parent companies, subsidiaries,
affiliates, partners, representatives, agents, successors, assigns, employees, officers,
and directors (“Released Parties”) from any and all liability for loss, harm,
damage, injury, cost, or expense whatsoever, including, without limitation,
property damage, personal injury, and/or death that may occur in connection
with, preparation for, travel to, or participation in the Contest, or participation
in, possession, acceptance, and/or use or misuse of any prize or participation
in any Contest-related activity, including, but not limited to, any claims
based on publicity rights, defamation or invasion of privacy, and merchandise
delivery. Sponsor shall not be responsible for any cancellations, delays,
diversions, substitutions, or omissions whatsoever by any persons providing any
services to winner, including any results thereof, such as changes in services
or location necessitated by same. Sponsor is not responsible if any part of a prize
cannot be awarded due to acts of God, acts of war, natural disasters, weather,
or acts of terrorism. Sponsor shall not be liable for any loss or damage to
personal belongings. Entrants who do not comply with these Official Rules or who
attempt to interfere with this Contest in any way shall be disqualified. There
is no purchase required to participate in the Contest or to win any prize in
the Contest. A purchase does not increase odds of winning.
7. ADDITIONAL TERMS:
Sponsor
reserves the right to alter, suspend, or terminate the Contest at any time and
with or without notice if, in Sponsor’s sole discretion, the integrity of the Contest
becomes or is likely to become compromised in any way. In the event the Contest
is terminated prematurely, all eligible entries received prior to the Contest
termination or suspension date will be included in the determination of any
prize winners. No automated devices, bots, and/or other programs and/or
software are permitted. All entries become the sole and exclusive property of
Sponsor and will not be acknowledged or returned. Delivery of a prize will
require a street address located within the (50) U.S. or District of Columbia
(D.C.). Sponsor is not responsible for late, incomplete, invalid, misdirected,
technically corrupted, or garbled entries, which will be disqualified, or for
problems of any kind, whether mechanical, human, or electronic. Only fully
completed entries are eligible. Proof of submission will not be deemed to be
proof of receipt by Sponsor.
In case of a dispute as to the identity of any SMS entrant,
an entry will be declared as made by the authorized account holder of the Mobile
Device used for entry. In case of a dispute as to the identity of any Internet
entrant, an entry made by Internet will be deemed made by the authorized
account holder of the e-mail address submitted at the time of entry. The
“authorized account holder” is deemed the natural person who is assigned to an
e-mail address by an Internet access provider, service provider, or other
online organization that is responsible for assigning e-mail addresses for the
domain associated with the submitted e-mail address. A potential winner may be
requested to provide Sponsor with proof that the potential winner is the
authorized account holder of the e-mail address associated with the winning
entry.
If for any reason the Contest is not capable of running as
planned, including due to infection by computer virus, bugs, tampering,
unauthorized intervention, automated entries, fraud, technical failure, human
error, or any other cause beyond the control of Sponsor that corrupts or affects
the administration, security, fairness, integrity, or proper conduct of the Contest,
Sponsor reserves the right, in its sole discretion, to disqualify any
individual who tampers with the entry process and to cancel, terminate, modify,
or suspend the Contest. Sponsor assumes no responsibility for any error,
omission, interruption, telephone or other communications malfunctions,
deletion, defect, delay in operation or transmission, communications line
failure, or theft or destruction of, unauthorized access to, or alteration of
entries. Sponsor is not responsible for any problems or technical malfunctions
of any telephone networks or lines, computer online systems, servers, or
providers, computer equipment, software, failure of any e-mail or entry to be
received by Sponsor on account of technical problems or traffic congestion on
the Internet or at any website, any combination thereof, or otherwise,
including any injury or damage to entrant’s or any other person’s computer
related to, or resulting from, participation or downloading of any materials in
the Contest.
Sponsor and its agents are not responsible for printing, distribution,
or production errors and may, in their sole discretion, rescind, cancel,
suspend, modify, or revoke this Contest based upon any such error without
liability. If by reason of a printing,
computer, or other error more prizes are awarded in a prize category than the
number set forth in these Official Rules, all persons purportedly making valid
claims will be included in a random drawing to award the advertised number of
prizes available. In no case will more than the advertised number of prizes be
awarded. Antifraud detection devices may be used for verification purposes. In
the event there is a discrepancy or inconsistency between disclosures or other
statements contained in any Contest materials and the terms and conditions of
the Official Rules, the Official Rules shall prevail, govern and control.
Sponsor’s failure to
enforce any term of these Official Rules shall not constitute a waiver of that
provision. Headings are solely for convenience and will not be deemed to affect
in any manner the meaning or intent of the documents or any provision hereof.
Caution: Any attempt by an entrant to deliberately damage any website or
undermine the legitimate operation of the Contest may be a violation of
criminal and civil laws, and should such an attempt be made, Sponsor reserves
the right to seek damages from any such person to the fullest extent permitted
by law.
IN NO EVENT WILL THE
RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY
KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE
DAMAGES ARISING OUT OF ENTRANT’S ACCESS TO, AND USE OF, THE WEBSITES AND/OR
THIS CONTEST, OR ENTRANT’S DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED
FROM ANY WEBSITES ASSOCIATED WITH THE CONTEST.
8. DISPUTES AND GOVERNING
LAW:
The parties
waive all rights to trial in any action or proceeding instituted in connection
with these Official Rules, including, without limitation, the Contest. Any
controversy or claim arising out of, or relating to, these Official Rules
and/or the Contest shall be settled by binding arbitration in accordance with
the commercial arbitration rules of the American Arbitration Association. Any
such controversy or claim shall be arbitrated on an individual basis and shall
not be consolidated in any arbitration with any claim or controversy of any
other party. The arbitration shall be conducted in New York City, New York.
THESE OFFICIAL
RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY, AND CONSTRUED
IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS
CONFLICTS OF LAWS AND RULES. For any matters that are not subject to
arbitration as set forth in these Official Rules and/or in connection with the
entering of any judgment on an arbitration award in connection with these Official
Rules and/or the Contest, the parties irrevocably submit and consent to the
exclusive jurisdiction and venue of the state and federal courts located in or
closest to New York City, New York. The parties agree not to raise the defense
of forum non conveniens.
9. USE OF DATA:
Sponsor will
be collecting personal data about entrants online, in accordance with its
Privacy & Cookie Policy. Please review Sponsor’s Privacy & Cookie Policy
at http://heinekenusa.com/privacy-cookie-policy/. By participating in the Contest, entrant hereby agrees to Sponsor’s
collection and usage of his/her personal information and acknowledges that
he/she has read and accepted Sponsor’s Privacy & Cookie Policy.
10. LIST OF WINNERS:
To obtain the name of winner(s), if any, send a
self-addressed, stamped envelope, with sufficient postage, to Winner List, Dos Equis Dos Million Bracket Challenge, P.O. Box 249,
Woodbridge, NJ 07095. All requests for a list of winners must be postmarked by 5/15/20
and received by 5/31/20.
