THE FIFTY UNITED STATES (“U.S.”) AND DISTRICT OF COLUMBIA (“D.C.”), AND IS OPEN
ONLY TO QUALIFIED PERSONS (AS DEFINED IN THE RULES BELOW). VOID ELSEWHERE AND WHEREVER PROHIBITED. BY PARTICIPATING IN THIS SWEEPSTAKES, YOU
AGREE TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF SPONSOR AND
ADMINISTRATOR. DO NOT PARTICIPATE IN THE
SWEEPSTAKES IF YOU DO NOT AGREE TO THESE OFFICIAL RULES AND FALL WITHIN THE
ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW.

Name: Almave Las Vegas Flyaway Sweepstakes (the “Sweepstakes”).
Sweepstakes
Dates: Sweepstakes registration is scheduled to begin at 12:00:00am
Eastern Time (“ET”) on 10/7/2024 and end at 11:59:59pm ET
on 10/27/2024 (the “Registration Period”). The
Sweepstakes is subject to all applicable federal, state and local laws and
regulations and is void outside of the fifty (50) U.S. and D.C., and wherever
prohibited or restricted by law.
Who may Enter: Sweepstakes
is open only to legal U.S. residents of the fifty (50) U.S. and D.C., who
are age 21 or older as of date of entry, and have a valid U.S. driver’s license
or government issued photo ID, except the following persons who are not
eligible to enter or win:
(a) Employees,
officers, and directors of Almave, LLC (“Sponsor”), Million
Dollar Media (the “Sweepstakes Administrator”), and each of the foregoing’s
respective franchisees, owners, employees, contractors, parents, affiliated
companies, subsidiaries, distributors, retailers, printers, advertising and
promotion agencies, and any and all other companies associated with the design
or execution of this promotion (collectively, “Released Parties”), and the
members of the immediate families or households, whether or not related, of any
of the above. “Immediate family members” includes, for purposes of this
promotion, parents (including in-laws), grandparents, siblings (including
step-siblings), children (including step-children), grand children (including
step grandchildren) and each of their respective spouses, regardless of where
they reside.
How to Enter – Four (4) Ways:
1.)
Online Registration: To receive
one (1) entry into the Sweepstakes via the Sweepstakes registration page, scan
the QR Code on any applicable point-of-sale material using your mobile device’s
camera or directly visit www.AlmaveGPFlyaway.com during the “Registration
Period”. Each entrant must fully
complete the online registration page with all required information including
his/her name, valid email address, phone number (including area code), state of
residence, and date of birth. After
having read and agreed to these Official Rules, click the submit button to
submit your online entry. The Sweepstakes Administrator’s computer, or that of
its designee, runs the official clock for the Sweepstakes and will solely
determine the time by which an entry is received. To receive five (5) additional Sweepstakes entries,
check the box on the registration form agreeing to receive offers and updates
via email from Sponsor. There is a
maximum total of six (6) entries into the Sweepstakes per eligible entrant via online
registration and email opt-in.
2.)
Social Media:
To receive one (1) entry into the Sweepstakes via social media, find
an applicable post about the Sweepstakes from @Almave on Facebook, Instagram,
TikTok, or Twitter (“X”) during the Registration Period, like and comment on
the post from your own non-private social media account with #AlmaveSweeps. To receive up to ten (10) additional entries
into the Sweepstakes, tag up to ten (10) friends that you know in your comment
(one (1) additional entry per friend you tag).
To enter the Sweepstakes in this method, you must be an active holder of
a Facebook, Instagram, TikTok or Twitter account. If you do not have the application for any of
these social media platforms, you may download them through the application
store on your mobile device. Each platform’s application is free, and their
Terms of Use apply. Meta (Facebook and
Instagram), TikTok, and Twitter are in no way Sponsors of, or in any way
affiliated with, this Sweepstakes. If
you enter using a mobile device on a wireless service provider’s network (as
opposed to a Wi-Fi network), your carrier’s text and data rates will apply. You
should consult your wireless service provider’s pricing plan for details. You
agree to incur any and all charges demanded by your wireless carrier. There is a maximum total of eleven (11)
entries into the Sweepstakes per eligible entrant via social media across all
social media platform entries combined.
3.)
Eligible Purchase: To receive up to two hundred ten
(210) entries into the Sweepstakes by making an eligible purchase, scan the QR
Code on any applicable point-of-sale material using your mobile device’s camera
or directly visit www.AlmaveGPFlyaway.com and fully complete the online
registration page with all required information including his/her name, valid
email address, phone number (including area code), state of residence, and date
of birth, and upload a photo of a valid receipt showing your purchase of one
(1) 750ML bottle of Almave Blue Agave Spirit (product does not contain alcohol)
during the Registration Period. Each
valid receipt submission equals ten (10) entries into the Sweepstakes. Each entrant may upload a maximum of one
unique valid receipt per day during the Registration Period for a maximum total
of two hundred ten (210) entries. NOTE: There is a maximum of one online entry
submission per person per day, regardless of the number of eligible receipts in
an entrant’s possession. Any
duplicate or ineligible receipt will not be honored or processed for bonus
entries. After having read and agreed to
these Official Rules, click the submit button to submit your online entry. All entries must be fully complete with all
required information, and must be received by 11:59:59 pm ET on October 27,
2024 to be eligible. Any entry
submitted with an invalid email address or other inaccurate, incomplete, or
incorrect information will be disqualified.
There is a maximum total of two hundred ten (210) entries into the
Sweepstakes per eligible entrant and valid receipts via online receipt upload.
4.)
Enter By Mail without a Purchase or Email
Opt-In: To enter by mail (no
purchase or receipt submission or email opt-in required), you must legibly
hand-print on a 3” x 5” card or piece of paper your first and last name,
complete address (including city, state and zip code), valid email address,
age, and phone number (including area code).
Mail completed 3” x 5” card or piece of paper in a #10, business-size
envelope with first-class postage affixed to: Almave Las Vegas Flyaway
Sweepstakes, P.O. Box 278, Woodbridge, NJ 07095. NOTE:
there is a limit one entry per outer mailing envelope. Mailing envelopes received with more than one
entry inside will be disqualified and none of the entries in the envelope will
be included in any prize drawings. You
may submit a maximum of one (1) individual mail-in entry per day during the
Registration Period. Any additional
mail-in entries received from the same individual with the same postmark date
that exceed a total of one (1) mail-in entry for that date, shall be
disqualified. Entrants shall receive fifteen
(15) entries for the first valid mail-in entry received, and ten (10) entries
for each valid mail-in entry received threreafter within the Registration
Period. Information on all entries must
be hand-printed. Incomplete or illegible
entries will be disqualified. All
mail-in entries must be postmarked by September 27, 2024 and received by November
1, 2024 to be eligible. There is a
maximum total of two hundred fifteen (215) entries into the Sweepstakes per
eligible entrant via mail-in entry.
NOTE:
there is a maximum of two hundred twenty-seven (227) entries per person from
all entry methods combined, based upon the entry methods outlined above. Entrants may not submit a receipt for entry
on the same day that a mail-in entry has been postmarked from the same
entrant. Entrant’s that opt-in to
receive emails from Sponsor may only receive a maximum total of two hundred ten
(210) entries via receipt submission or mail-in entry combined – entrants may
not exceed a total of two hundred ten (210) entries from these two entry
methods combined if they have opted-in to receive emails from Sponsor. Any incomplete or illegible entries, or any
entries submitted with an invalid or false information, duplicate or invalid
receipt, email address or phone number will be disqualified. Released Parties are not responsible for
lost, late, misdirected, illegible, incomplete, invalid, unintelligible,
damaged, or postage-due mail-in entries, or for entries submitted in a manner
that is not expressly allowed under these rules, or for any entry not submitted
or received due to any technical error or failure, unauthorized human
intervention, inaccurate capture or mis-entry of any required information, or
the failure to capture any such information for any reason including
programming or technical errors, or effects of hackers or failure of any
electronic equipment, computer or cellular transmissions and/or network
connections; all of which will be disqualified.
Any available opt-in opportunities are not required to
enter the Sweepstakes, and opting-in will not improve your chances of winning. By
participating and submitting an entry, entrant agrees that sponsor and
participating parties are authorized to contact entrant via email, text, mail,
phone or any other form of media to make entrant aware of information pertinent
to the Sweepstakes, and to distribute information regarding the Sponsor(s)
featured products, special events or future contests, promotions or
offers. Entrants may opt-out of any further email communication at
any time by simply replying REMOVE to any email message, or following the
provided opt-out instructions.
Each participant must submit an entry on his/her own
behalf. Any entry submitted on behalf of another individual or using
another person’s email address, social media account, name or mobile number
will be disqualified and ineligible to claim any prize. Any attempt
by any participant to obtain more than the stated number of entries allowed by
using same, multiple/different accounts, mobile numbers, identities, or any
other methods void that participant's entries and that participant may be
disqualified. No mechanically reproduced or automated entries
permitted. Use of any automated system to participate is prohibited
and will result in disqualification and all such entries will be deemed
void. All entries received become the property of the Sponsor and
will not be returned.
All entries in the Sweepstakes
will become the sole property of Sponsor and will not be returned. Each entrant agrees that their submitted entry
may be viewed by the public and used for marketing purposes by Sponsor. Sponsor reserves the right to disqualify and
remove any entry at any time that is not in compliance with these Official
Rules. All entries must conform to the
submission requirements as outlined above and below, or it may be disqualified
and not considered for the Sweepstakes.
All entries must
include all required information. Any
entry with incorrect, incomplete or illegible information or other inaccurate
information will be disqualified.
Sponsor, Administrator and their
respective equity holders, owners, partners, members, directors, managers,
officers, employees, consultants, contractors, lenders, advisors, sponsors,
volunteers, insurers, agents, attorneys, representatives, successors and
assigns (“Released Parties”) are not responsible for lost, late,
misdirected, incorrect, illegible, incomplete, invalid, unintelligible or
damaged entries, or for any entry submitted in a manner that is not expressly
allowed under these Official Rules, or for any entry not submitted or received
due to any technical error or failure, human error, unauthorized human
intervention, inaccurate capture or mis-entry of any required information,
failures, omissions, interruptions, deletions, or defects of any phone or
cellular phone provider, network computer online systems, computer equipment,
servers or software, including any injury or damage to entrant’s or any other
person’s computer relating to or resulting from participation in this Sweepstakes;
or the failure to capture any such information or effects of hackers or failure
of any electronic equipment, computer, phone line or cellular transmissions
and/or network connections; all of such entries will be disqualified.
In the event of a dispute as to any entry registration, the
authorized account holder of the mobile phone, email address, and/or social
media account used to register will be deemed to be the registrant and he/she
must be eligible according to these Official Rules. The “authorized
account holder” is the natural person listed on the account by the cellular
service provider, internet service provider, or social media provider
associated with the account(s) used to submit the entry by any of the available
entry methods.
By
participating and submitting an entry, entrants agree that Sponsor and
participating parties are authorized to contact them via email, mail, phone, social
media direct message from the platform used to enter, or any other form of
media to make entrants aware of information pertinent to the Sweepstakes, and
to distribute information regarding the Sponsor(s) featured products, special
events or promotional offers. Entrants may
opt-out of any further email communication at any time by simply replying
REMOVE to any email message, or following the provided opt-out instructions. Any available opt-in opportunities are not required
to enter the Sweepstakes, and checking the opt-in boxes will not improve your
chances of winning.
By
registering and submitting an entry, you affirm that you have read and accepted
these Official Rules. The
laws of the U.S. apply to and govern this Sweepstakes, and any claims must be
raised and resolved in the U.S. Any
information collected by registering and entering the Sweepstakes shall be used
only in a manner consistent with these Official Rules and with Sponsor’s
Privacy Policy. By entering the Sweepstakes, each entrant agrees that s/he may
be contacted, recorded and/or broadcasted by Sponsor, and that his/her comment,
post and/or submission may be used, promoted, released, broadcasted or
published by Sponsor in any manner related to the promotion or advertising of
the Sweepstakes.
General
Submission via Social Media Requirements:
(a)
Each
entry must be submitted in a format as accepted by the applicable social media
platform, and must be the entrant’s own original creation and not previously
submitted in the Sweepstakes; and
(b)
Any
entry that is not properly submitted or received for any reason, including any
technical difficulties, upload failures, failures to save or properly store the
entry and/or submitted comment, busy signals, efforts of hackers or any lost or
disconnected Internet connections, will be disqualified.
Additional
Submission Requirements: Sponsor reserves the right to, in its sole
and absolute discretion, disqualify any entry and/or submission for any reason
that it considers to not be appropriate for the Sweepstakes. Entry submission restrictions include, but
are not limited to, the following requirements:

may
not include, depict or reference any individual under the age of twenty-one
(21), or that appears to be under the age of twenty-one (21);
·
not
be, or ever have been, previously submitted in the Sweepstakes;
·
except
as relates to the Sponsor’s brand(s) or approved partners, not include
trademarks, logos or copyrighted material not owned by entrant or material that
is used without permission (including, but not limited to, company names,
photographs, works of art or images published on any media) or that otherwise
infringes or violates the rights of any third-party (including, but not limited
to, copyrights, trademarks, patents, trade secrets, logos, contract and
licensing rights, rights of publicity or privacy, moral rights (i.e., “droit
moral”) or any other intellectual property rights);
·
not
feature, display, refer to, or mention any companies or brands in competition
with Sponsor;
·
not
include any unauthorized photos, images, comments or plagiarism of any kind;
·
not
contain or reference nudity, inappropriate, indecent, sexually explicit,
pornographic or obscene content or images (which shall be determined by
Sponsor, in its sole and absolute discretion);
·
not
contain any political or politically themed or motivated messages, comments,
statements or images;
·
not
defame, slander, libel, misrepresent or contain disparaging remarks or any
other content that could adversely affect the name, reputation or goodwill of the
Released Parties or any other individuals and/or entities affiliated or
associated with Sponsor, the Sweepstakes or any prizes, the determination of
which shall remain in the sole discretion of Sponsor;
·
not
depict or include any comments, descriptions or images that may be considered
unlawful, harmful, threatening, violent, abusive, harassing, tortuous,
defamatory, vulgar, libelous, invasive of another’s privacy, hateful, or
racially, religiously, ethnically or otherwise objectionable in any manner as
solely determined by Sponsor;
·
not
be subject to any third-party agreement or require payment or incurrence of any
sums to obtain further permissions of any person or entity as a result of its
use or exploitation of the comment(s), photo, idea or rights therein or
portions, or modified versions or derivative works thereof;
·
not
include any name, likeness, description, photograph or any other identifying
element, in whole or in part, of any person, living or dead, without
permission;
·
not
depict or describe the mistreatment or abuse of animals; and,
·
not
depict or describe misuse or irresponsible use of Sponsor’s products or any
other similar product.
Representation and Release of Rights to Sweepstakes
Entry and/or Submission: By submitting any entry, each entrant
represents that s/he has sole and exclusive ownership and proprietary rights of
all content submitted; has full permission of all parties within any comment, photo,
or video to publish and release their images and actions shown within the
comment, photo, or video; and agrees that each entry and/or submission becomes
the sole and exclusive property of Sponsor, and Sponsor may publish, display, promote
or utilize the submission, content and/or photo or video in any manner of its
choosing in relation to the promotion or advertising of the Sweepstakes or
Sponsor. Entry into the Sweepstakes and
upload of any entry, comment and/or photo constitutes permission for the
Sponsor and its designees to use that entrant’s entry, comment, photo, name,
city and state of residence and/or likeness for purposes of advertising and
trade in any and all media now or hereafter known worldwide in perpetuity
without limitation or further compensation, notification or permission, unless
prohibited by law. Submissions will not
be acknowledged or returned by Sponsor.
Sponsor reserves the right to
request proof from any entrant, at any time, in a form acceptable to Sponsor,
of any permission required or possibly required to use such entrant’s entry in
the Sweepstakes. Failure to provide such
proof, if requested, may disqualify such entry from the Sweepstakes.
Sponsor
reserves the right, in its sole discretion, to disqualify any individual (and
all of his or her entries) who tampers or attempts to tamper with or abuse the
entry process or the Sweepstakes website in any way or who is otherwise in
violation of these Official Rules, as determined by Sponsor or the Sweepstakes
judges appointed by Sponsor in their sole and absolute discretion. Any questions regarding the number of entries
submitted or the authorized account holder shall be determined by Sponsor in its
sole discretion. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY SWEEPSTAKES
WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A
VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE,
SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON
TO THE FULLEST EXTENT PERMITTED BY LAW.
Winner Selection and Notification (1 grand prize
winner): A random prize drawing will be held on or about 10/28/2024 from
among all eligible entries received from all entry methods combined, to
select a maximum of one (1) potential prize winner (see prize description
below).
The potential winner will be notified initially by phone
and/or email following their selection. If the Administrator is
unsuccessful in its attempt to reach and speak directly with the selected
potential prize winner by phone within 4-hours of the initial notification
attempt to the phone number or email address associated with that entrant’s
entry, then that entrant may be disqualified and an alternate potential winner
may be randomly selected from among the remaining eligible entries and notified
as per the procedures outlined above (time permitting).
During winner notification, the selected potential winner
must confirm their eligibility, and indicate their willingness and ability to
accept the prize. The potential winner will then receive official
notification via mail or email delivery. If the selected winner does
not meet the eligibility requirements, or is unable or unwilling to accept the
prize or elects to decline the prize, s/he will be disqualified and, at
Sponsor’s discretion and time permitting, an alternate winner will be randomly
selected from among all remaining eligible entries and notified as per the
procedures outlined above. Any disqualified entrant will not receive
any alternate prize substitution or compensation. Decisions of
the Administrator in the selection and determination of the winners and all
matters relating to this Sweepstakes are final and binding.
All of the following will apply to each winner: 1) Winner
will be required to complete and return, within 1-day of date of receipt, a
prize acceptance form, including an affidavit of eligibility and a
liability/publicity release (publicity release where permitted) and
a W-9 form; 2) Winner may be required to present a copy of a valid
social security card and a valid driver’s license as a condition of receiving
any prize; and 3) Winner will be issued a 1099 and is solely
responsible for paying all applicable taxes (including, but not limited to all
local, state and federal taxes) on all prizes awarded.
Grand Prize Award (maximum 1 winner): The
eligible entrant designated as the grand prize winner shall be awarded a 3-day,
2-night trip for the winner and one (1) guest (age 21 or older) to Las Vegas,
NV scheduled for November 23, 2024 to November 25, 2024, with a maximum retail
value not to exceed $7,900 and shall include:

Roundtrip
coach-class airfare departing on November 23, 2024 and returning on November 25,
2024 for winner and one (1) guest (21 years of age or older) from the
nearest major metro airport to the winner’s home to Las Vegas, NV (LAS
airport). Airline, class of service, and departure/arrival airports as
solely determined and designated by Sponsor and subject to availability.
o
NOTE: If grand prize winner resides within 250-miles of the
greater Las Vegas, NV metro area, Sponsor reserves the right to provide a $500
gift card toward ground transportation in lieu of airfare.
·
Two
(2) nights in a standard double-occupancy hotel room in the greater Las Vegas,
NV metro area checking in on November 23, 2024, and checking out on November 25,
2024. Hotel and dates of stay as solely
determined and designated by Sponsor based upon availability;
·
Two
(2) tickets to a Sponsor-designated auto-racing event scheduled to take place
in Las Vegas, NV on November 24, 2024.
Ticket type, ticket delivery method, and event details as solely
determined and designated by Sponsor, subject to availability;
·
One
(1) $500 gift card toward ground transportation and incidentals. Gift card
subject to the terms and conditions, including any expiration, of the issuing
gift card provider policy. Please allow
4-6 weeks for delivery.
The grand prize award has an approximate retail value
(“ARV”) of $7,900. Actual ARV based upon
final travel accommodations, dependent on winner’s home location.
All ground transportation, airport/hotel transfers,
parking, meals, gratuities, checked baggage fees, airline seat assignment fees,
hotel resort fees, travel or departure taxes, incidental expenses, applicable
taxes (including, but not limited to all local, state and federal taxes) and
any other expenses not specified herein as being included in the prize award
are the sole responsibility of winner.
Winner and guest shall be subject to any qualifying
conditions prior to and during travel including any local government
regulations in the departure or destination location, airline and/or hotel
requirements, or any regulation related to COVID-19 testing requirements,
vaccination status or policy. Any
testing requirements, vaccination and/or any related quarantine requirements
and expenses are the sole responsibility of, and at the sole expense of winner
and guest.
Travel dates are based upon availability, and as solely
determined and designated by Sponsor.
Sponsor is not responsible for any travel delays, flight delays or
cancellations or travel difficulty related to prize award, redemption or
use. If travel delays or difficulty
prevent arrival in time for any and all elements of such prize award, Sponsor
is not responsible for awarding any compensation in lieu thereof. Sponsor is not responsible for late, lost,
damaged or stolen luggage.
The winner and his/her guest must travel together on the
same itinerary. Any changes to completed
travel arrangements, once booked, are the sole responsibility of the winner,
and are solely at the winner’s expense.
Actual value of the trip will depend on point of departure, and any
airfare fluctuations. If actual value of
prize is lower than the stated ARV of the prize award when it is procured and
fulfilled, then the difference will NOT be awarded to the winner. The winner and travel companion are solely
responsible for all costs incurred to and from the nearest major airport to the
winner’s home as designated by Sponsor as the prize originates and terminates
at such departure point unless otherwise agreed to by Sponsor in writing.
Grand prize winner and guest must be of legal age of
majority in his/her state of residence (and at least 21) and will be required
to execute and return a liability/publicity release prior to prize award. It is recommended that winner and travel
companion obtain sufficient personal insurance prior to departure. Winner and travel companion hereby release
Sponsor from any duty to provide, check, or verify any and all necessary ID’s,
passports, visas and tourist cards, birth certificates, vaccination certificates,
and any other travel requirements (“Personal Documents”). Sponsor shall not have any responsibility for
the replacement of lost or stolen Personal Documents or tickets, coupons,
vouchers, receipts or other documents pertaining to the prize (“Travel
Documents”) once the Travel Documents have been provided to winner and travel
companion.
Sponsor will not be responsible for any travel delay,
rescheduling, postponement or cancellation for any reason including but not
limited to weather, pandemic, an Act of God, Force Majeure, government
regulation or restriction, an act of terrorism, civil disturbance, work
stoppage, or any other reason. No
substitute prize award or compensation shall be provided by Sponsor in the
event of any travel delay, rescheduling, postponement, or cancellation for any
reason, and winner shall be subject to the terms and conditions of the airline
ticket and hotel policy, and shall solely look to the airline ticket and hotel
provider.
Winner and guest agree to comply with all applicable
airline and hotel provider rules, requirements and regulations in connection
with the prize award, redemption and use. Sponsor and travel provider reserve
the right to remove or deny entry to winner and/or his/her guest who do not
comply with any rule, requirement, instruction, policy, or who engage in a
disruptive manner, or with intent to annoy, abuse, threaten, or harass any
other person. Winner and guest shall be
solely responsible for their behavior while traveling, must follow the
instructions and direction from any travel provider or associated staff or
security. If winner or any guest
violates the standards of the travel provider, behaves in an inappropriate,
irresponsible or offensive manner, or is deemed by staff or security to have
violated any rule, regulation or policy of the travel provider, or to be a
security threat in any manner, the winner and guest shall be ejected or denied
travel arrangements, and shall immediately forfeit the remaining prize award.
Event tickets delivery method is at sole discretion of tour
provider which will be either sent to winner by mail, email, mobile ticketing
or placed at venue Will Call the day of tour under the winner’s name. Winner
must be present to pick up tickets and a valid photo ID will be required if
tickets are placed at Will Call. Event tickets are subject to age
restrictions. Resale of event tickets is
prohibited. Event and venue management (“Event Entities”) reserve the right to
revoke full or partial prize from winner or winner’s guest who Event Entities
personnel deem may, in its sole discretion, be intoxicated, be a safety risk,
have violated any ticket or venue policy or law, or may bring Event Entities
into disrepute. By claiming event tickets, you agree to the Event Entities’
policies, and to abide by the health and safety measures in effect at the time
of the event, which may include, without limitation, wearing masks, providing
proof of vaccination status and/or providing proof of negative COVID-19 test
administered by an approved facility. Should any event be cancelled or access
to the venue be restricted, you will be notified as soon as reasonably
possible.
Prize winner must accept delivery of prize in the method as
solely determined and designated by Sponsor.
Prize shall be shipped only to the designated winner residential address
as submitted during initial online registration and/or as provided during
winner notification, via the carrier as determined and designated by Sponsor
(i.e. UPS, USPS or other Sponsor designated carrier), or as otherwise specified
by Sponsor such as e-ticket delivery to the email address provided during
registration and/or as provided during winner notification. Allow 4 – 6 weeks for prize delivery.
Once emailed, delivered, transferred via mobile delivery or
shipped, prize shall be considered as awarded and delivered, and Sponsor shall
not be responsible for actual receipt of delivery by winner. Winner is solely responsible for any required
software application for access to mobile ticket delivery. Sponsor shall not be responsible for any
lost, late, undelivered, misdirected, damaged or stolen delivery; or any
incorrect delivery address or information provided by winner during
registration or prize claim. In the
event of any delivery issues, including undelivered, misdirected, lost or
stolen deliveries, Sponsor shall have no responsibility to replace the prize
award, and prize award shall not be substituted by Sponsor with any alternate
prize award or compensation. Winner
shall look solely to designated shipper/carrier for any lost, damaged, stolen
or mis-delivered packages and not to Sponsor for any delivery issues.
The terms and conditions of the tickets awarded as a prize
will govern in the event of any cancellation, postponement, rescheduling or
attendance restriction due to any Force Majeure Event including weather,
pandemic, an Act of God, an act of terrorism, civil disturbance, work stoppage
or any other reason. Sponsor will not be responsible for event date delay,
rescheduling, postponement or cancellation due to any Force Majeure Event or
any other event that may cause the cancellation, rescheduling or postponement
of the event as scheduled. No substitute
prize award or compensation shall be provided by Sponsor in the event of any
event cancellation for any reason.
The winner and guest shall be solely responsible for their
behavior while in attendance at the event, must follow the instructions of
Sponsor, policy of the venue/event and directions from any associated staff or
security. If winner or any guest
violates the standards of the venue/event, behaves in an inappropriate,
irresponsible, or offensive manner, or is deemed by staff or security to have
violated any policy of the venue or event, or to be a security threat in any
manner, the winner and their guest shall be ejected from the venue and event,
and shall immediately forfeit the prize award.
General Prize Conditions: No
alcoholic beverage is part of any prize award. Prize award may
be delivered digitally, via mobile ticket transfer, or shipped to winner’s
residential address as provided at the time of entry and/or winner notification
via USPS or other Sponsor designated shipping/mail carrier. Once
delivered via digital or mobile transfer or shipped, the prize shall be
considered awarded, delivered and fulfilled, and Sponsor shall have no
responsibility for any shipment that is delayed, damaged, lost, misdelivered,
undelivered or stolen, or any incorrect mobile number, email or shipping
address provided by winner. In the event of any delivery issues,
prize award shall not be replaced or substituted with any alternate prize award
or compensation. Winner shall look solely to shipping carrier for
any lost, damaged, misdelivered, undelivered, stolen or delayed shipment. Total ARV of all available prizes: $7,900.
All other costs and expenses related to prize acceptance,
delivery, redemption or use not specified herein as being provided are the sole
responsibility of winner. All income, federal, state and local taxes
are the winner’s sole responsibility. All prizes are awarded as is,
without any warranty, express or implied, by Sponsor. All prize
awards are non-transferable and no cash redemption or prize substitution
allowed, except at Sponsor’s sole discretion or as provided
herein. Sponsor reserves the right to substitute a prize with one
(1) of comparable or greater value, at its sole discretion. Failure
to collect or properly claim prize in accordance with these Official Rules will
result in forfeiture of the prize. If forfeited for any reason,
entrant will not receive any other prize substitution or compensation, and
the prize will remain the property of Sponsor and will not be awarded, except
as provided herein. All properly claimed prizes will be
awarded. Any unclaimed prizes will not be awarded.
Additional Rules & Restrictions: By
participating, entrants agree to abide by and be bound by the Official Rules
and the decisions of the Sponsor and Administrator, which shall be final in all
matters relating to this Sweepstakes. In the event an entrant wins a
prize, and is later found to be in violation of these rules he/she will be
required to forfeit the prize or to reimburse Sponsor for the stated value of
the prize if such violation is discovered after winner has used the prize.
Participation in Sweepstakes constitutes permission for the Sponsor, the
Released Parties and their designees to use entrants’ names, likenesses,
images, biographical information, and cities and states of residence for
purposes of advertising and trade in any and all media now or hereafter known
worldwide on perpetuity without limitation or further compensation,
notification or permission, unless prohibited by law. False,
fraudulent or deceptive entries or acts shall render entrants ineligible for
any prize.
By participating, entrants agree to hold all Released
Parties harmless from any claims, losses, actions, or damages of any kind,
whether actual, incidental or consequential, for injury (including but not
limited to death), damages, losses or expenses arising out of or relating to
entrant’s participation in this Sweepstakes, or the acceptance, possession or
use/misuse of any prize, or participation in prize-related activities
(including but not limited to travel or activity related thereto), and to assume
all liability therefor.
Released Parties shall not be liable to winner or any other
person for failure to supply the prize or any part thereof by reason of any
acts of God, any actions, regulations, orders, or requests by any governmental
entity, equipment failure, terrorist acts, war, fire, unusually severe weather,
embargo, labor dispute or strike, labor or material shortage, transportation
interruption of any kind, or any other cause beyond Released Parties’ sole
control.
Participants are restricted to use of ordinary and typical
computer equipment, mobile phone equipment, Internet access and cellular
networks. Sponsor disclaims all liability for the inability of a participant to
complete or continue an entry due to equipment malfunction, busy lines,
inadvertent disconnections, acts beyond the Sponsor’s control, or otherwise.
The Sponsor disclaims any liability for entries not received due to technical
difficulties or transmission errors. The Sponsor disclaims all liability for
any delays, mis-delivery, loss, or failure in the delivery of any item sent by
mail, courier, express, electronic transmission, or other delivery
method. Released Parties are not responsible for mechanical,
technical, electronic, communications, telephone, computer, hardware or
software errors, malfunctions or failures of any kind, including: failed,
incomplete, garbled or delayed transmission of online entries, traffic
congestion on telephone lines, the Internet or at any website or lost or
unavailable network connections which may limit an online entrant's ability to
participate in the Sweepstakes, and any injury or damage to entrant’s or any
other person’s computer or mobile phone related to or resulting from
participating in or downloading any information necessary to participate in the
Sweepstakes. Released Parties are not responsible for any other
errors of any kind, whether computer, technical, typographical, printing, human
or otherwise, relating to or in connection with the Sweepstakes, including,
without limitations, errors which may occur in connection with the printing or
advertising of this Sweepstakes, administration or execution of the
Sweepstakes, the cancellation of the game, the processing of entries or in the
announcement of the prizes or prize winners. Sponsor, in its sole
discretion, reserves the right to disqualify any person tampering with the
entry process or the operation of the Sweepstakes website.
Sponsor reserves the right to cancel, modify, reschedule or
terminate the Sweepstakes for any reason including, but not limited to acts of
God, pandemics, force majeure, government regulatory action or
ruling, fraud, misconduct, or if any technical failures destroy or
threaten the integrity of the Sweepstakes, in the opinion of the
Sponsor/Administrator, or if a computer virus, bug, or other technical problem
corrupts the administration, security, or proper conduct of the Sweepstakes as
determined by Sponsor/Administrator, in their sole discretion. In the event of
early termination of the Sweepstakes, Sponsor reserves the right to determine
prize winners in a random drawing from among all eligible, non-suspect entries
received as of the time/date of such termination.
IN CASE OF DISPUTES: By
participating, each entrant agrees that (1) any and all disputes, claims, and
causes of action arising out of or in connection with this Promotion, or any
prizes awarded, shall be resolved individually, without resort to any form of
class action, and any judicial proceeding shall take place in a federal or
state court within the State of New Jersey; (2) any and all claims, judgments,
and awards shall be limited to actual out-of-pocket costs incurred, including
costs associated with entering this Promotion, and in no event will entrant be
entitled to received attorneys' fees or other legal costs; and (3) under no
circumstances will entrant be permitted to obtain awards for, and entrant
hereby waives all rights to claim, punitive, incidental, and consequential
damages, and any other damages, other than for actual out-of-pocket expenses,
and any and all rights to have damages multiplied or otherwise increased. All
issues and questions concerning the construction, validity, interpretation and
enforceability of these Official Rules, or the rights and obligations of
entrant and Sponsor in connection with this Promotion, shall be governed by,
and construed in accordance with the laws of the State of New Jersey, without
giving effect to any choice of law or conflict of law rules or provisions
(whether of the State of New Jersey or any other jurisdiction), that would
cause the application of the laws of any jurisdiction other than the State of
New Jersey.
Odds: Odds of being selected as the
prize winner are dependent upon the total number of eligible entries received
from all entry methods combined.
