(the ‘Contest’)
Contest Location: Floor & Decor, 490 Payne Rd Scarborough, Portland,
ME 04074 (the “Event
Location”)
Contest Timing: Registration
for the Contest at the Event Location starts on 9/14/2024 at approximately 9:30am
(ET) and continues through the earlier of either (i) 1:00pm
(ET), or (ii) the point at which two-hundred (200)
individuals who meet the eligibility requirements have registered to
participate in this Contest (each, a “Contestant”), whichever is sooner (the
“Registration Period”). The Contest will begin on 9/14/2024 at approximately 10:00am
(ET) and continue through the earlier of either (i) 1:00pm
(ET) or (ii) the point at which two-hundred (200) Contestants
have completed their attempt in the Contest, whichever is sooner (the “Contest
Period”). Notwithstanding the foregoing, whether or not all 200 Contestants who
timely register and line up have the opportunity to
participate or not, this Contest will immediately end at 1:00pm (ET). Contest Administrator is
the official time-keeper for all matters related to
this Contest.
Who May Enter: In order to participate
in this Contest, an individual must be a legal resident of MA,
ME, NH, or VT who resides within 250 miles of Portland, ME who is 18 or older as of date of entry with a
valid driver’s license or government issued photo ID, who is present during the
Contest Period at the Event Location, and who
is one of the first two-hundred (200) individuals in line to meet the
eligibility requirements and complete the required registration (see below
under ‘How to Enter’) as solely determined by the Contest Administrator, except the following classes
of persons who are not eligible to enter:
(a)
Employees, officers, and directors of Floor & Decor, (the
“Sponsor”), Million Dollar Media (the “Contest Administrator”), each of their respective franchisees, affiliated companies,
subsidiaries, distributors, retailers, printers, advertising and promotion
agencies, and any and all other companies associated
with the design or execution of this contest (collectively, “Released Parties”) and the members of the
immediate families or households of any of the above, whether or not related.
“Immediate family members” includes, for purposes of this contest, parents
(including in-laws), grandparents, siblings (including step-siblings),
children (including step-children), grand children (including step
grand-children) and each of their respective spouses.
(b)
Individuals who are unable or unwilling to be present to participate in
the grand prize contest event on 9/14/2024.
How to Register:
During the
Registration Period, be one of the first two-hundred
(200) people to visit the check-in table at the Event Location to obtain the
Contest website URL address to access the Contest registration page on your
mobile device or (if available) provided Contest Administrator device. Data rates may apply as per your mobile/wireless carrier’s
rate plan. Such rates may apply even if use of the mobile device does not
result in a Contest entry. Internet access may not be available on all wireless
carriers or in all areas. Only the first two-hundred
(200) eligible individuals as solely determined by the Contest Administrator
may have the opportunity to register for the Contest.
Each individual must fully complete the
registration page with all required information including his/her name,
address, city, state, zip code (no P.O. boxes), valid email address,
phone number (including area code), and answers to Sponsor qualitative
questions. After having read and agreed to these official rules, click the
submit button to complete your registration.
All online registrations must be fully complete for all required
information. Any online registration
submitted with an invalid email address will be disqualified. Incomplete or illegible entries will be
disqualified. Released Parties are not
responsible for lost, late, misdirected, illegible, incomplete, invalid,
unintelligible, damaged, or for registrations submitted in a manner that is not
expressly allowed under these rules, or for any
registration not submitted or received or lost due to any technical error or
failure, human or programming error, unauthorized human intervention,
inaccurate capture or mis-entry of any required information, or the failure to
capture any such information or effects of hackers or failure of any electronic
equipment, computer transmissions and/or network connections; all of which will
be disqualified.
Maximum of one registration per person and per email address
in this Contest, regardless of method used to register. No more than two-hundred (200) registrations will be allowed in this
Contest. Each
individual must register on his/her own behalf. Any registration submitted on behalf of
another individual or using another person’s email address or name will be
disqualified and ineligible to claim any prize.
Any attempt by any individual to obtain more than the stated number of
registrations allowed by using same, multiple/different email addresses,
identities, or any other methods void that individual’s registrations
and that individual may be disqualified.
No mechanically reproduced or automated registrations permitted. Use of any automated system to participate is
prohibited and will result in disqualification and all such registration will
be deemed void.
In the event of a dispute as to any online registration, the
authorized account holder of the e-mail address used to register will be deemed
to be the registrant and he/she must be eligible according to these Official
Rules. The “authorized account holder” is the natural person assigned an e-mail
address by an Internet access provider, online service provider or other
organization responsible for assigning e-mail addresses for the domain
associated with the submitted address.
All registration information received becomes the property of the
Sponsor and will not be returned.
Decisions of Contest Administrator in the selection
of Contestants and participation in the Contest are final. Difficulties with
getting to Event Location to register or participate in the Contest are not the
responsibility of Sponsor or Contest Administrator. Sponsor and Contest Administrator reserve the right to modify the event
date or time of the Contest, at its sole discretion for any reason including
but not limited to inclement weather, schedule conflicts, acts of God, flight
delays, or any other reason that prevents event to occur as scheduled.
Any available opt-in opportunities are not required to register for the Contest, and
checking the opt-in boxes will not improve your chances of winning. By registering for and participating in this Contest, Contestant agrees
that Sponsor and participating parties are authorized to contact Contestant via
email, mail, phone or any other form of media to make Contestant aware of
information pertinent to the Contest, and to distribute information regarding
the Sponsors featured products, special events or promotional offers, or
purchase incentives. Contestants may
opt-out of any further email communication at any time by simply replying
REMOVE to any email message, or following the provided
opt-out instructions.
Obtain an Entry Ticket: Upon
completion of your registration, the Contest Administrator (or a designee of
the Contest Administrator) shall confirm you are one of the first two-hundred (200) individuals in line
and who have registered to participate in this Contest, and that your registration has been completed per the
requirements set forth in these official rules.
Upon this verification, the Contest Administrator (or a designee of the Contest Administrator)
shall provide the Contestant with one (1) official ticket
(“Ticket”). Obtain and secure your
Ticket until your Contest attempt, and immediately get in line at the Contest
area inside the store for a chance to attempt the Contest. In the event of any disagreement between
contestants that involves the order in which one or more contestants can
attempt the Contest, the Administrator shall determine in his/her sole
discretion the exact order in which each eligible contestant shall be allowed
to attempt the Contest.
There is a maximum of one
Ticket per person, and maximum of two hundred (200) Tickets available for this
Contest. Sponsor and Contest
Administrator are not responsible for lost, misplaced, damaged, destroyed or
mutilated Tickets. Any Ticket that has
been copied, duplicated, manipulated, or altered in any manner, or that is
deemed illegible, as solely determined by Contest Administrator, shall be void
and the Contestant will be disqualified.
Last time to receive a Ticket will be at the close of the Registration
Period or at a deadline as solely determined by Administrator.
Redeem Ticket: Immediately prior to your Contest attempt,
hand the Administrator who is at the Contest area your Ticket. Upon receipt of your Ticket, you will be
instructed to attempt the Contest.
Grand Prize Contest: In order for the grand
prize to be awarded to an eligible Contestant, the Contestant must 1) present
their Ticket to the Contest Administrator; 2) print and sign their full name on
the first unoccupied line of the provided official contestant registration form
prior to their dice roll attempt and; 3) roll all 6 dice provided by Contest
Administrator and have each die come to rest with the predetermined winning
side face up, on a single dice roll attempt.

Eligible dice roll attempt
requirements
·
All dice roll attempts must occur in the presence of the Contest Administrator, and must be recorded on video tape in its
entirety. Any dice roll attempt not in
the presence of the Contest Administrator, or that is not videotaped for any
reason will be disqualified and is not eligible for the grand prize;
·
Contestants will not be permitted to take any practice or warm-up tosses
prior to their attempt. Once a die has been rolled, their attempt is considered to be started.
·
Each eligible Contestant
must roll all 6 dice all at one time. Contestants
may not attempt to change the outcome of any rolled die, by hitting the die
with a subsequent roll attempt;
·
All (6) dice must be rolled
on each individual contest attempt. The
winning outcome must occur during a single roll attempt – i.e. Contestants may
not combine sides during multiple roll attempts. Each roll is its own unique Contest attempt
and the (6) winning sides must all
land face-up on a single roll.
·
Each die must be tossed in a completely
random manner that does not allow the Contestant to “set” or “slide” the dice,
alter or influence the random outcome of the roll;
·
Each die must be rolled a minimum of 2-feet
in distance from the Contestant, in order to prevent
the Contestant from altering, affecting, influencing, or enhancing the random
outcome of any roll. The Contest
Administrator will designate the demarcation line that each die must cross
during the roll;
·
All dice must come to rest lying flat;
·
All dice must land on and remain on the
designated dice rolling surface;
·
No rolled die may come in
contact with any person or object other than the designated rolling
surfaces or walls.
·
If any die comes in contact with another
person or object (other than the dice roll surface or designated walls or
backstop) for any reason; or if any person or object in any way interferes,
alters, changes, influences or affects the random outcome of the roll, then the
entire attempt is disqualified and the Contestant may
not receive another attempt.
The
following will result in the Contestant being required to re-roll their entire
dice roll attempt:
If any of the following
outcomes occur, that dice roll attempt is disqualified and the Contestant will
be granted a maximum of one re-roll attempt (the Contestant must re-roll all 6 dice):

If the Contest Administrator deems that any
die has failed to cross the dice roll demarcation line;
·
If any die is leaning in any manner;
·
If any die leaves the designated dice roll
playing surface;
·
If any Contestant inadvertently drops a die
as they are preparing to roll, and the dropped die does not meet the
eligible
dice roll requirements as stated in the
Contest rules.
In all circumstances, an
eligible Contestant may have a maximum of one re-roll attempt. In the event of a second ineligible dice
roll, their entire dice roll attempt will be disqualified and the Contestant
will not be eligible for any prize claim regardless of the outcome of their
roll.
Prize Awards
& Delivery:
Second
Prize: In the event an
eligible Contestant rolls all 6 dice provided by Contest Administrator and a
maximum of 4 of 6 dice come to rest with the predetermined winning side face up
(i.e. exactly 4 winning sides face up and
2 non-winning sides face up), the eligible Contestant who completed the Contest
requirements will be awarded the second prize, subject to approval and verification of
compliance with these official rules.
The Second Prize is: a Floor & Decor
merchandise card in the amount of $100.00 US. A maximum of (10) Second Prizes
will be awarded to the first (10) Contestants who successfully complete the Contest
requirements. Merchandise card is
subject to the terms and conditions of the Floor & Decor merchandise card
policy. Sponsor reserves the right, in
its sole discretion, to award multiple merchandise cards in varying
denominations to satisfy the total amount to be awarded. Please allow 6-8 weeks for delivery of Second
Prize.
First
Prize: In the event an
eligible Contestant rolls all 6 dice provided by Contest Administrator and a
maximum of 5 of 6 dice come to rest with the predetermined winning side face up
(i.e. exactly 5 winning sides face up and
1 non-winning side face up), the eligible Contestant who completed the Contest
requirements will be awarded the First Prize,
subject to approval and verification of compliance with these official
rules. The First Prize is: a Floor & Decor merchandise card in the amount
of $1,000.00 US. A maximum of (5) First
Prizes will be awarded to the first (5) Contestants who successfully complete
the Contest requirements. Merchandise
card is subject to the terms and conditions of the Floor & Decor
merchandise card policy. Sponsor
reserves the right, in its sole discretion, to award multiple merchandise cards
in varying denominations to satisfy the total amount to be awarded. Please allow 6-8 weeks for delivery of First
Prize.
Grand Prize: In the event of a successful dice roll
attempt (i.e. all 6 dice come to rest with the predetermined
winning side face up), the eligible Contestant
who completed the Contest requirements will be awarded the Grand Prize subject to approval and
verification of compliance with these official rules. The Grand Prize
is: $1,000,000
US 40-year annuity, awarded in the form of $25,000 US cash per year for
40-years without interest. The initial
prize award of $25,000 US cash shall be awarded within approximately 30-days of
receipt of all required prize acceptance paperwork, and each subsequent payment
shall occur on or about the anniversary date of the first payment for
39-years. No current cash value of the
annuity prize award will be available.
A maximum of (1) Grand Prize will be awarded. In the event of multiple winning rolls by
more than one eligible Contestant, then the value of the grand prize shall be
evenly distributed among eligible Contestants who have successfully completed
the grand prize dice roll requirements (i.e. if there are two winning roll
attempts, then each Contestant shall be awarded a $500,000 US 40-year annuity,
payable as $12,500 US per year). In the event there is no Grand Prize winning attempt, then the Grand Prize will NOT be
awarded.
Winner(s) must accept
delivery of prize from Sponsor, or as otherwise instructed by Sponsor. All other costs related to prize delivery and
acceptance is the responsibility of winner including but not limited to
federal, state and local taxes. All
properly claimed prizes will be awarded.
Prizes are non-transferable and no cash redemption or prize substitution
allowed, except at Sponsor’s sole discretion or as provided herein. Sponsor reserves the right to substitute a
prize of equal or greater value if an advertised prize becomes unavailable.
Prize winners will be required to complete and
return a W-9 form (if prize value exceeds
$600.00 US), affidavit of eligibility, and liability/publicity release (Tennessee residents need not sign publicity
release), and
present a valid driver’s license (or government issued photo ID) and social
security card before prize will be awarded.
Winners of prizes greater than $600.00 US will be issued a 1099 form
reflecting the value of the prize(s) and are responsible for paying all taxes
on prize(s). Failure to collect or
properly claim any prize in accordance with these rules will result in
forfeiture of the prize. If forfeited
for any reason, Contestant will not receive any other prize substitution or
compensation. Total ARV of all available
prizes: $1,000,000 US 40-year annuity plus $6,000 US cash.
Additional Rules
& Restrictions: By participating in this Contest,
Contestants agree to abide by and be bound by the Official Rules and the
decisions of the Contest Administrator, which shall be final in all matters
relating to this contest. In the event a
Contestant wins a prize, and is later found to be in
violation of these rules he/she will be required to forfeit the prize or to
reimburse Sponsor for the stated value of the prize if such violation is
discovered after winner has used the prize. Participation in Contest
constitutes permission for the Sponsor and its agencies to use Contestant’s names,
likenesses, photo, video, quote, etc. for purposes of advertising and trade in
any media worldwide without limitation or further compensation unless
prohibited by law. False, fraudulent or
deceptive entries or acts shall render entrants
ineligible for any prize.
Sponsor and Contest Administrator are not
responsible for any typographical or other error in the printing or advertising
of the offer, administration or execution of the Contest or in the announcement
of the prizes/prize winners. By
participating, Contestants agree to hold all Released Parties harmless from any
claims, losses, actions, or damages of any kind, whether actual, incidental or
consequential, for injury (including but not limited to death), damages, losses
or expenses arising out of or relating to entrant’s participation in this Contest,
or the acceptance, possession or use/misuse of any prize, or participation in
prize-related activities (including but not limited to travel related thereto),
and to assume all liability in connection therewith.
Released Parties shall not be liable to any winner,
Contestant or any other person for failure to supply the prize or any part
thereof by reason of any acts of God, any actions, regulations, orders, or
requests by any governmental entity, equipment failure, terrorist acts, war,
fire, unusually severe weather, embargo, labor dispute or strike, labor or
material shortage, transportation interruption of any kind, or any other cause
beyond Releasees’ sole control. No more
than the advertised maximum number of prizes will be awarded for any reason.
In no event will the Released Parties be held liable to winner,
Contestant or any other person and Contestants hereby waive, to the extent
permitted by law, any demands, claims or allegations of damages incurred by
itself or its agents, employees, assignees, and representatives in association
with this Agreement, including any unintentional exposure or harm due to
COVID-19. Further, Contestants and any other person including agree to comply
with all of the rules, policies, and regulations
implemented in accordance with standard COVID-19 protocols at that time. Contest
Administrator reserves the right to cancel, modify or terminate the Contest if
fraud, misconduct or technical failures destroy or threaten the integrity of
this portion of the Contest, in the opinion of the Contest Administrator, or if
a computer virus, bug, or other technical problem corrupts the administration,
security, or proper conduct of the Contest as determined by Administrator, in
its sole discretion. Sponsor and Contest Administrator reserve the right to
modify the event date or time of the Contest, at its sole discretion for any
reason including but not limited to inclement weather, schedule conflicts, acts
of God, flight delays, or any other reason that prevents event to occur as
scheduled.
IN CASE OF DISPUTES: By participating, each Contestant agrees that (1)
any and all disputes, claims, and causes of action arising out of or in
connection with this Contest, or any prizes awarded, shall be resolved
individually, without resort to any form of class action, and any judicial
proceeding shall take place in a federal or state court within the State of New
Jersey; (2) any and all claims, judgments, and awards shall be limited to
actual out-of-pocket costs incurred, including costs associated with entering
this Contest, but in no event attorneys' fees; and (3) under no circumstances
will Contestant be permitted to obtain awards for, and entrant hereby waives
all rights to claim, punitive, incidental, and consequential damages, and any
other damages, other than for actual out-of-pocket expenses, and any and all
rights to have damages multiplied or otherwise increased. All issues and
questions concerning the construction, validity, interpretation and
enforceability of these Official Rules, or the rights and obligations of
entrant and Sponsor in connection with this Contest, shall be governed by, and
construed in accordance with the laws of the State of New Jersey, without
giving effect to any choice of law or conflict of law rules or provisions
(whether of the State of New Jersey or any other jurisdiction), that would cause
the application of the laws of any jurisdiction other than the State of New
Jersey.
Odds:
The odds of a Contestant winning the grand prize by successfully rolling
the dice are: 1:46,656.
