THE HEINEKEN® PLAYER 0.0 CONTEST (“CONTEST”) IS OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA (D.C.) WHO ARE TWENTY-ONE (21) YEARS OF AGE OR OLDER AS OF DATE OF ENTRY. CONTEST IS GOVERNED EXCLUSIVELY BY THE LAWS OF THE UNITED STATES.

BY ENTERING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A BINDING CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES CERTAIN RELEASES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES, INCLUDING A WAIVER OF YOUR RIGHT TO A TRIAL BY JURY.

At any time, Sponsor has the right to, at its sole discretion and without prior notification, change or discontinue any aspect or feature of (the set-up of) Player 0.0 Contest and Mobile Game, and to change or modify the Contest Rules, Mobile Game Rules, or any part thereof, or to impose new conditions. Such changes, modifications, additions, or deletions shall be effective immediately upon posting of the modified Contest Rules or Mobile Game Rules. If you do not agree to abide by these or any future Contest Rules or Mobile Game Rules, do not (continue to) participate in Player 0.0 Contest. You are advised to regularly read the Contest Rules and Mobile Game Rules for possible changes.

This Contest consists of two (2) parts: (a) an online “Sim Racing Game” contest (“Online Contest”), and (b) a Grand Prize in-person “Sim Racing Game” competition (“Grand Prize Competition”). Collectively, the Online Contest and the Grand Prize Competition are referred to as the “Contest,” and the Online Contest Period and Grand Prize Competition Period as the “Contest Period”.

1. ELIGIBILITY:

The Contest is open to all legal residents of the fifty (50) United States and the District of Columbia who are 21 years of age and older at time of entry except as set forth below.

Notwithstanding the foregoing, the following individuals and members of their families (parents, grandparents, children, siblings, spouses) and immediate household members (whether related or not) are not eligible for participation: employees, officers, and directors of HEINEKEN USA Inc. (“Sponsor”), Million Dollar Media (“Administrator”), and each of their parent, subsidiary, and affiliated companies, alcoholic beverage suppliers, wholesalers, distributors, and importers, alcoholic beverage retailers, and Sponsor’s advertising and promotional agencies. All federal, state, and local regulations apply.

Note: In order to win and claim the grand prize finalist qualifier prize (see below), entrants must have a valid passport with at least seven (7) months from the end of the scheduled return date before passport expires, from the date of the internation Grand Prize Competition. The Grand prize winners’ guest must also have a valid passport with at least seven (7) months from the scheduled travel return date before passport expires. In the event a passport and/or visa is required and winner and/or winner’s guest does not have a valid passport, winner and/or guest has (15) days from date they are notified that they are a grand prize finalist qualifier prize winner to obtain a valid passport and/or visa, or winner will be disqualified and prize may be awarded to an alternate entrant.

2. START/END DATES:

The Online Contest begins at 12:01 a.m. Eastern Time (ET) on 8/19/2024 and ends at 11:59 p.m. ET on 10/12/2024 (“Online Contest Period”). The Grand Prize Competition is scheduled to occur on 10/29/2024 (“Grand Prize Competition”), and shall be open only to the six (6) grand prize finalist qualifiers from the Online Contest, as outlined below. (Note: Grand Prize Competition date is subject to change at Sponsor’s sole discretion.)

3. HOW TO ENTER – INTERNET ENTRY: To enter, scan the QR Code on applicable point-of-sale signage materials using your mobile device’s camera or directly visit www.Heineken.com/us/en/promos/Player00. Follow the on-screen instructions to download the Heineken Player 0.0 mobile game to your mobile device. Follow the instructions to participate in the online Player 0.0 mobile game to obtain your score for that particular attempt. If you wish to submit your mobile game score to the online leader board to be eligible to qualify for the Grand Prize Finalist Qualifier Prize Award (see below), you must follow the instructions to click where indicated to submit your online score and complete the online registration for that game play attempt (each a “Contest Entry”). Any mobile game score that is not submitted or received for any reason, shall not be eligible or considered for Grand Prize Finalist Qualifier Prize eligibility. Sponsor not responsible for any entrant who fails to submit their score to the leaderboard for any reason, and any unsubmitted scores shall not be eligible on considered for qualification. Normal time rates, if any, charged by Internet service provider will apply. All Player 0.0 mobile game participation, associated mobile game scores and Contest entries must be submitted by 11:59 p.m. ET on 10/12/2024.

You may participate in the Player 0.0 mobile game as often as you wish, and submit more than one qualifying mobile game score result to the leaderboard. Each participation and mobile game score submission requires a unique registration per above.

By participating and submitting an entry, entrants fully and unconditionally agree to be bound by these Official Rules and the decisions of Sponsor and its appointed agents, which will be final and binding in all matters relating to the Contest. Any entry submitted on behalf of another individual or using another individual’s information, providing any incorrect, inaccurate, fake or false information during registration, or attempting to submit more than the allowable number of entries by using alternate names, emails, addresses, or other method shall result in all such entries being disqualified. Please note that there is a limit of one (1) prize per individual, household, street address, and/or email address during any six (6) month period across all HEINEKEN USA Inc. promotions, regardless of brand (Heineken, Amstel, Dos Equis, Murphy’s, Newcastle, Red Stripe, Strongbow, Tecate, and Tiger).

4. PRIZES:

All Contest prize details are at Sponsor’s sole discretion. Any prize depiction is for illustrative purposes only and shall not be relied upon. No part of any prize includes any alcoholic beverages. Prize is not transferable or redeemable for cash. No substitution of prize by winner is allowed, but Sponsor reserves the right to substitute a prize of equal or greater value at its sole discretion.

· NOTE: There is a maximum limit of one (1) prize award per person, email address or household during the entire Contest Period, except for this Contest, the Grand Prize Finalist Qualifiers prize winners are still eligible for the Grand Prize. If eligible entries are less than the scheduled number of prizes available for any prize level or total number of prizes available for the entire Contest, then the associated prize awards shall not be awarded.

· Sponsor reserves the right in its sole discretion to substitute any prize award with an alternate prize award of approximate equal or greater value, based upon availability.

(a) Grand Prize Finalist Qualifier Prize Award (6): Six (6) grand prize finalist qualifier prize awards will be available to be awarded. Each grand prize finalist qualifier prize award consists of: a trip for two (2) people (winner and one guest, age 21 or older) to the Sponsor designated destination city (located within the contiguous U.S.) during the Sponsor designated travel dates (scheduled for October 28 – 30, 2024), for the winner to participate in the U.S. Finalist Heineken Player 0.0 in-person Sim Racing Game Competition scheduled to occur on 10/29/2024 (note: guest is excluded from participation in the Competition).

NOTE: designated destination city to host U.S. Finalist Heineken Player 0.0 in-person Sim Racing Game Competition shall be as solely determined and designated by Sponsor, and U.S. Competition is scheduled to occur on 10/29/2024. Competition and designated travel dates are subject to change at Sponsor’s sole discretion.

Each grand prize finalist qualifier prize includes: round-trip coach class airfare for winner and one (1) guest (age 21 or older) from the nearest major metro airport to winner’s residential home address as designated by Sponsor to the Sponsor designated airport serving the U.S. host city location; two (2) nights hotel accommodations for two (2) people—one room, double occupancy at a Sponsor-designated hotel in the designated destination city metro area; one (1) $500 gift card from the Sponsor designated gift card provider towards a travel stipend, one (1) $500 Uber.com e-gift card towards hotel/airport and event transfers, and the opportunity for the winner only (guest excluded) to participate in the U.S. Finalist Heineken 0.0 Player 0.0 in-person Sim Racing Game Competition. (NOTE: if winner resides within 150 miles of designated destination city or the host site of the in-person Sim Racing Game competition event location, Sponsor reserves the right to award a $500 travel stipend, in lieu of airfare. Travel stipend shall be awarded as a gift card from the Sponsor designated gift card provider, and subject to the terms and conditions of the issuing gift card provider policy.) Approximate retail value (“ARV”) of each grand prize finalist qualifier prize award: $4,000. Total ARV of all available grand prize finalist qualifier prize awards: $24,000.

Winner and guest must each execute an Affidavit of Eligibility and Publicity Release form provided by Sponsor or its appointed agent prior to issuance of tickets. Winner’s guest must be twenty-one (21) years of age or older as of the date of departure and must travel on the same itinerary and at the same time as winner. Travel must be round-trip. Winner and guest are solely responsible for obtaining any required travel documents, including a valid passport where applicable, vaccinations, COVID-19 testing or vaccination, and travel insurance. Travel restrictions, conditions, and limitations may apply. In the event that the winner and/or winner’s guest does not have a valid passport, winner and/or guest has fifteen (15) days from date they are notified that they are a winner or guest to obtain a valid passport and/or visa, or winner will be disqualified and prize may be awarded to an alternate winner.

Grand Prize Competition event date, time and rules of participation are in the sole discretion of event organizer and Sponsor, as applicable, and may be subject to change. Sponsor will not be responsible for any event delay, rescheduling, postponement or cancellation for any reason including due to force majeure, weather, pandemic, an Act of God, an act of terrorism, civil disturbance, work stoppage, government regulation or any other reason; and no prize substitution shall be provided by Sponsor in any such event.

Participation in the in-person Sim Racing Game Competition is subject to the official rules of the Competition as provided at the event, and the terms and conditions, policy and procedures and rules of conduct of the event organizer and hosting venue. Winner and guest must comply and abide by all applicable event and venue regulations and policies in connection with the prize, and follow the instruction of any event staff or security. Sponsor, event organizer and venue reserve the right to revoke participation in the Grand Prize Competition and/or to remove or deny entry to winner and/or his/her guest who engage in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person at any game, or whom are deemed to be intoxicated, be a safety or security risk, have violated any event or venue policy or law, and/or may bring Sponsor into disrepute.

Any expenses or costs not expressly stated in the description of the prize above, including, but not limited to, ground transportation, hotel and airport transfers, event transfers, parking fees, meals, incidentals, gratuities, passenger tariffs or duties, surcharges, airport fees, service or facility charges, airline seat assignment or baggage check fees, personal charges at lodging, security fees, taxes, or other expenses, are the sole responsibility of winner. Actual value of grand prize finalist qualifier prize shall be subject to airfare and hotel reservation rates at the time of travel arrangements. If the actual value of prize is less than the stated ARV, winner shall NOT receive the difference and no alternate prize award or compensation shall be provided.

Travel dates shall be as solely determined and designated by Sponsor (scheduled for October 28 – 30, 2024, or as otherwise designated by Sponsor). Exact airline transportation, accommodation details, travel dates, and terms to be determined at the sole discretion of Sponsor. Transportation and accommodations are subject to availability. Blackout dates and other restrictions may apply. Once travel arrangements are booked, any penalties incurred as a result of changes to travel (flight or hotel) are the sole responsibility of winner. In the event the winner chooses to cancel their trip, or winner or guest chooses not to travel for any reason, Sponsor shall not award any alternate prize award or compensation and shall have no liability for any related cancellation fees or additional costs incurred for re-booking the itinerary at a later date. Travel is subject to the terms and conditions set forth in these Official Rules and those set forth by Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. Hotel accommodations are subject to the terms and conditions set forth in these Official Rules and those set forth by Sponsor’s hotel of choice. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers, or certificates. All travel arrangements are subject to any applicable restrictions, regulations, and policies of the travel providers (including airline and hotel) including COVID-19 vaccination and/or testing policy, and policies of departure and destination locations (including national, state, or local entry, vaccination, testing, or quarantine policies, or prohibitions on entry). Sponsor is not responsible should any part of prize award not be usable in part or in whole due to the foregoing. Prize must be taken in accordance with government guidelines and COVID-19 rules and restrictions in both the departure and arrival location. Any required arrangements and additional costs for any COVID-19 testing, vaccination or quarantine accommodations that may be required is sole responsibility of the winner and guests.

Prize winners must accept delivery of prize in the method as solely determined and designated by Sponsor (i.e. mobile ticket delivery or other ticket delivery method). In the event of any mobile or digital ticket delivery, winner is solely responsible for any required software application required to download, accept transfer, access or redeem mobile or digital ticket delivery. Once transferred or delivered, prize shall be considered delivered to winner and Sponsor shall have no responsibility for any delivery that is delayed, damaged, lost, misdelivered, not received or stolen.

Sponsor will not be responsible for any travel arrangements that are delayed, rescheduled, postponed or cancelled due to pandemic, any government restrictions, pandemic regulations or requirements, travel provider restrictions or policies, weather, Acts of God, force majeure, acts of terrorism, civil disturbances, work stoppage or any other reason or event that may cause the delay, rescheduling, postponement or cancellation of any travel arrangements. No refund or compensation will be made in the event of the cancellation, delay, rescheduling or postponement of any travel arrangements. Winner and guest must abide by all travel provider policies and direction, including security and safety requirements. Sponsor reserves the right to revoke full or partial prize from winner or winner’s guest who it and/or travel provider personnel deem may, in their sole discretion, be intoxicated, be a safety risk, is disruptive or abusive, have violated any policy or law, and/or may bring Sponsor into disrepute.

(b) Grand Prize Award (1): One (1) grand prize award will be available to be awarded. The grand prize consists of: a trip for two (2) people (winner and one guest, age 21 or older) to Madrid, Spain during the Sponsor designated travel dates (scheduled for December 10 – 14, 2024), for the winner to participate in the Global Finalist Heineken Player 0.0 in-person Sim Racing Game Competition scheduled to occur on 12/13/2024 (note: guest is excluded from participation in the Competition).

NOTE: Global Competition event date, destination city and designated travel dates are subject to change at Sponsor’s sole discretion.

The grand prize includes: round trip coach class airfare for two (2) people from the Sponsor designated airport servicing winner’s residential home area to the Sponsor designated airport serving Madrid, Spain (i.e. MAD); hotel accommodations for two (2) people—one room, double occupancy—for three (3) nights at the Sponsor designated hotel in the Madrid, Spain metro area; one (1) $1,000 gift card from the Sponsor designated gift card provider towards a travel stipend, and the opportunity for the winner only (guest excluded) to participate in the Global Finalist Heineken 0.0 Player 0.0 in-person Sim Racing Game Competition, scheduled to be hosted by Max Versteppan. ARV of grand prize: $7,500.

Winner’s guest must be twenty-one (21) years of age or older as of the date of departure and must travel on the same itinerary and at the same time as winner. Travel must be round-trip. Winner and guest are solely responsible for obtaining any required travel documents, including a valid passport where applicable, vaccinations, COVID-19 testing or vaccination, and travel insurance.

Winner must be present at the date, time and location to register and participate in the in-person Sim Racing Game Competition. Participation in the in-person Sim Racing Game Competition is non-transferable. Failure to be present at the date, time and location as specified by Sponsor for any reason, including travel delays or difficultly, shall result in forfeiture of the opportunity to participate in the in-person Sim Racing Game competition, and no alternate prize award or compensation will be provided. Sponsor is not responsible for any schedule conflicts, illness, non-appearance, delay or cancellation by Max Versteppan to be present or host the event for any reason, and no alternate prize award or compensation shall be provided in the event of non-attendance at event.

Travel dates shall be as solely determined and designated by Sponsor (scheduled for December 10 – 14, 2024 or as otherwise designated by Sponsor). All expenses and travel costs incurred as a result of seeking, winning, and/or making use of a prize are the sole responsibility of winner. Any expense or cost not expressly stated in the description of the prizes set forth above is solely the responsibility of winner.

All federal, state, and local taxes, fees, and surcharges on any prize are the sole responsibility of winner of the prize. Winners of prizes with a value of $600 or more will be issued an IRS Form 1099-MISC early in the year following the year in which prize was awarded for filing with his/her federal and state tax returns. Sponsor complies with all tax reporting requirements. The amount of any tax liability will vary depending on winner’s tax bracket.

5. ODDS OF WINNING:

Odds of winning a grand prize finalist qualifier prize award in the Contest is dependent on the total number of eligible entrants and the skill and ability of each entrant in their participation in the on-line “Sim Racing Game” contest.

Odds of winning the grand prize, once selected as a grand prize finalist qualifier are based upon the skill and ability of each grand prize finalist qualifier participating in the in-person Sim Racing Competition.

6. WINNER SELECTION, NOTIFICATION, AND VERIFICATION:

There is a maximum limit of one (1) prize award per person, email address or household during the entire Contest Period, except for this Contest, the Grand Prize Finalist Qualifiers are still eligible for the Grand Prize.

By accepting the prize, each winner agrees to being interviewed, photographed, and filmed when receiving the prize and agrees to provide all active cooperation with any promotional activities and reasonable publicity arising from the prize. All resultant material, including participants' name, image and comments, may be used by Heineken and each of their subsidiaries, affiliates, related companies, advertising and promotion agencies and each of its and their respective directors, employees, agents and representatives (the "Heineken Parties") at their sole discretion to the fullest extent and for any purpose, including for Heineken's future promotional and marketing purposes in any manner whatsoever, including print, broadcast and internet, without further reference and free of charge.

(a) Grand Prize Finalist Qualifiers

At the conclusion of the Online Contest Period, Sponsor shall review the submitted Player 0.0 mobile game scores and determine the eligible participants who are among the top six (6) scorers in the online “Sim Racing Game”. Sponsor reserves the right to disqualify any submitted score submitted to or posted to the leader board that is not verified by Sponsor’s internal game keeping system, or is determined to be altered, manipulated, false or fraudulent in any manner, in its sole discretion.

· NOTE: In the event of a tie among the top six (6) eligible mobile game scorers on the online leader board, the first entrant who submitted the tied score to the leader board shall be designated as the qualifier. Sponsor’s time clock and record of date and time of score submission shall be the sole determinant of the first entry received.

· In the event of a remaining tie, Sponsor reserves the right to conduct a random drawing among any tied participants to determine the eligible Grand Prize Finalist Qualifiers.

The eligible participants who are determined by Sponsor to be among the top six (6) scorers in the online “Sim Racing Game” portion of the contest, as solely determined and designated by Sponsor in its sole discretion, shall be designated as potential Grand Prize Finalist Qualifier prize award winners.

Determination of potential Grand Prize Finalist Qualifier prize award winners shall be conducted and determined by Sponsor or its appointed agent, and all decisions are final. Potential winners will be contacted by telephone and/or email. If any potential winner cannot be reached within twenty-four (24) hours of first notification attempt, if any prize or prize notification is returned as undeliverable, if the potential winner rejects his/her prize, or in the event of noncompliance with these Official Rules, such prize will be forfeited and an alternate winner will be selected from among all remaining eligible entries. Upon forfeiture of any prize, no compensation will be given.

All potential winners will be required to sign and return, where legal, a Declaration of Eligibility and Liability/Publicity Release within one (1) day of receipt and notification that he/she is a potential winner. No potential winner will be an official winner until his/her Declaration of Eligibility and Liability/Publicity Release has been returned and eligibility has been formally verified by Sponsor. If any potential winner fails to comply with these Official Rules and/or to submit the required documentation within the designated time period, he/she will be automatically disqualified and the prize may be awarded to an alternate winner, time permitting.

(b) Grand Prize

Each grand prize finalist qualifier prize winner must attend the in-person “Sim Racing Game” competition to be eligible for the grand prize award, and must be willing and able to travel to the Sponsor designated international destination city to participate in the Global Finalist Heineken Player 0.0 in-person Sim Racing Game Competition.

At the conclusion of the in-person “Sim Racing Game” competition, the event organizer shall determine the grand prize winner from among the six (6) eligible Grand Prize Finalist qualifiers per the competition rules as solely determined and designate by event organizer and Sponsor. The determination of the grand prize winner, shall be at the sole discretion of event organizer and Sponsor. Event organizer and Sponsor reserve the right to disqualify any Grand Prize Finalist qualifier for any reason in its sole discretion, including fraud, cheating, or any behavior in violation of event policy and as listed in these Official Rules. Determination of the Grand Prize winner shall be conducted by Sponsor, event organizer or its appointed agent, and all decisions are final.

If the potential winner rejects his/her prize, or in the event of noncompliance with these Official Rules, such prize will be forfeited and an alternate winner will be selected from among all remaining eligible finalists. Upon forfeiture of any prize, no compensation will be given.

The potential winner will be required to sign and return, where legal, a Declaration of Eligibility and Liability/Publicity Release within one (1) day of receipt and notification that he/she is athe potential winner. No potential winner will be an official winner until his/her Declaration of Eligibility and Liability/Publicity Release has been returned and eligibility has been formally verified by Sponsor. If the potential winner fails to comply with these Official Rules and/or to submit the required documentation within the designated time period, he/she will be automatically disqualified and the prize may be awarded to an alternate winner, time permitting.

7. LICENSE AND RELEASE:

By participating and/or accepting a prize, entrants and winners acknowledge and agree to release and hold harmless Sponsor, Sponsor’s advertising and promotional agencies, and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers, and directors (“Released Parties”) from any and all liability for loss, harm, damage, injury, cost, or expense whatsoever, including, without limitation, property damage, personal injury, and/or death that may occur in connection with, preparation for, travel to, or participation in the Sweepstakes, or participation in, possession, acceptance, and/or use or misuse of any prize or participation in any Sweepstakes-related activity, including, but not limited to, any claims based on publicity rights, defamation or invasion of privacy, and merchandise delivery. Sponsor shall not be responsible for any cancellations, delays, diversions, substitutions, or omissions whatsoever by any other persons providing any services to winner, including any results thereof, such as changes in services or location necessitated by same. Sponsor is not responsible if any part of a Sweepstakes prize cannot be awarded due to acts of God, acts of war, natural disasters, weather, or acts of terrorism. Sponsor shall not be liable for any loss or damage to personal belongings. Entrants who do not comply with these Official Rules or who attempt to interfere with this Sweepstakes in any way shall be disqualified. There is no purchase required to participate in the Sweepstakes or to win any prize in the Sweepstakes. A purchase does not increase odds of winning.

8. ADDITIONAL TERMS:

Sponsor reserves the right to alter, suspend, or terminate the Contest at any time and with or without notice if, in Sponsor’s sole discretion, the integrity of the Contest becomes or is likely to become compromised in any way. In the event the Contest is terminated prematurely, all eligible entries received prior to the Contest termination or suspension date will be included in the next prize drawing. No automated devices, bots, and/or other programs and/or software are permitted. All entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Delivery of a prize will require a street address located within the United States or the District of Columbia. Sponsor is not responsible for late, incomplete, invalid, unintelligible, misdirected, technically corrupted, or garbled entries, which will be disqualified, or for problems of any kind, whether mechanical, human, or electronic. Only fully completed entries are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.

In case of a dispute as to the identity of any Internet entrant, an entry made by Internet will be deemed made by the authorized account holder of the email address submitted at the time of entry. The “authorized account holder” is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry.

If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, automated entries, fraud, technical failure, human error, or any other cause beyond the control of Sponsor that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify, or suspend the Contest. Sponsor assumes no responsibility for any error, omission, interruption, telephone or other communications malfunctions, deletion, defect, delay in operation or transmission, communications line failure, or theft or destruction of, unauthorized access to, or alteration of entries. Sponsor is not responsible for any problems or technical malfunctions of any telephone networks or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to, or resulting from, participation or downloading of any materials in the Contest.

Sponsor and its agents are not responsible for printing, distribution, or production errors and may, in their sole discretion, rescind, cancel, suspend, modify, or revoke this Contest based upon any such error without liability. If by reason of a printing, computer, or other error more prizes are awarded in a prize category than the number set forth in these Official Rules, all persons purportedly making valid claims will be included in a random drawing to award the advertised number of prizes available. In no case will more than the advertised number of prizes be awarded. Antifraud detection devices may be used for verification purposes. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control.

Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Headings are solely for convenience and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.

Caution: Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF ENTRANT’S ACCESS TO, AND USE OF, THE WEBSITES AND/OR THIS CONTEST, OR ENTRANT’S DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE CONTEST.

9. DISPUTES AND GOVERNING LAW:

The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. Any controversy or claim arising out of, or relating to, these Official Rules and/or the Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in New York City, New York.

THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS AND RULES. For any matters that are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Contest, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to New York City, New York. The parties agree not to raise the defense of forum non conveniens.

Sponsor will be collecting personal data about entrants online, in accordance with its Privacy & Cookie Policy. By participating in the Contest, entrant hereby agrees to Sponsor’s collection and usage of his/her personal information and acknowledges that he/she has read and accepted Sponsor’s Privacy & Cookie Policy.

11. LIST OF WINNERS:

To obtain a list of winners, send a self-addressed, stamped envelope, with sufficient postage, to Winners List, Heineken® Player 0.0 Contest, P.O. Box 248, Woodbridge, NJ 07095. All requests for a list of winners must be postmarked by 12/15/2024 and received by 12/31/2024.
