IS VALID ONLY IN THE FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA (D.C.), AND IS OPEN ONLY TO QUALIFIED PERSONS (AS DEFINED IN THE
RULES BELOW) WHO ARE TWENTY-ONE (21) YEARS OF AGE OR OLDER AS OF THE DATE OF
ENTRY. VOID ELSEWHERE AND WHEREVER
PROHIBITED. BY PARTICIPATING IN THIS PROMOTION,
YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF SPONSOR AND
ADMINISTRATOR. DO NOT PARTICIPATE IN THE
PROMOTION IF YOU DO NOT AGREE TO THESE OFFICIAL RULES AND FALL WITHIN THE
ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW.
Promotion
Name: Wheatley Vodka Trivia Promotion (the “Promotion”).
Promotion Dates: The Promotion consists of a trivia
contest (the “Contest”) with a registration period that begins at 12:00:00 am
Eastern Time (ET) on 9/10/2024 and
ends at 11:59:59 pm (ET) on 3/30/2025 (the
“Registration Period”). Following the
end of the Registration Period, a random drawing will be held on or about 4/1/2025
to determine one (1) contest winner of an educational experience (the “Experience”;
see details below). The Promotion is subject to all applicable
federal, state and local laws and regulations.
Void outside the (50) U.S. and D.C., and wherever prohibited or
restricted by law.
Eligibility
– Who May Enter: Promotion is open
only to legal residents of, and who are located within, the fifty (50) United
States or D.C., who are age twenty-one (21) or older as of date of entry, do
not have or hold an interest in any alcoholic beverage retail license in the
United States, and have a valid U.S. driver’s license or government-issued
photo ID, except the following persons who are not eligible to enter,
participate, or receive the Experience award:
(a) Employees, officers, and directors of Sazerac
Company, Inc. (“Sponsor”), Million
Dollar Media (the “Promotion Administrator”), and each of the
foregoing’s respective franchisees, owners, employees, contractors, parents,
affiliated companies, subsidiaries, distributors, retailers (specifically,
those having or holding an interest in any alcoholic beverage retail license),
printers, advertising and promotion agencies, any and all other companies
associated with the design or execution of this Promotion, or any officers,
directors, members, or shareholders of any alcohol-beverage retailers,
distributors, wholesalers or manufacturers (collectively, “Released Parties”),
and the members of the immediate families or households, whether or not
related, of any of the above. “Immediate family members” includes, for purposes
of this Promotion, parents (including in-laws), grandparents, siblings
(including step-siblings), children (including
step-children), grandchildren (including step grandchildren) and each of their
respective spouses, regardless of where they reside.
How to Enter –
Online Registration: To enter, find the
registration link from a Promotion related printed or digital invite which will
contain an entry registration code, or directly visit www.WheatleyTriviaChallenge.com during the Registration Period, enter your registration
code, and follow the on-screen registration instructions to register for use of
the Promotion site. NOTE: only one (1) entry registration per person and/or
email address. Each entrant must fully
complete the online registration page with all required information including
his/her name, valid email address, phone number (including area code), date of
birth, full residential address, and any other required information on the
registration page. After having read and
agreed to these Official Rules, click the submit button to submit your online registration
and navigate to the Wheatley Vodka Trivia Challenge trivia contest page on the
website. Follow the online instructions
to complete the trivia game for your chance to receive the Experience in the
Contest (award descriptions below).
All entries must be
submitted by 11:59:59p ET on 3/30/2025 to be eligible for the Contest. Maximum of
one entry per person or email address. Each participant must submit an entry on his/her own behalf. Any entry submitted on behalf of another
individual or using another person’s name or email address, or providing any
false information, will be disqualified and ineligible to claim award. Any attempt by any participant to obtain more
than the stated number of entries allowed by using same, multiple/different
emails, identities, or any other methods void that participant's entries and that participant may be disqualified. No mechanically produced or automated
entries permitted. Use of any automated system to participate is prohibited and will
result in disqualification and all such entries will be deemed void. False and/or deceptive entries or acts,
including misrepresentation of age, shall render such entries ineligible.
To be eligible for the Experience award, all trivia questions must
be answered correctly. Any entry with
incorrect, incomplete or illegible information, an invalid email address or
other inaccurate information will be disqualified. Released
Parties are not responsible for lost, late, misdirected, incorrect, illegible,
incomplete, invalid, unintelligible, or damaged entries, or for entries
submitted in a manner that is not expressly allowed under these Official Rules,
or for any entry not submitted or received due to any technical error or failure,
human error, unauthorized human intervention, inaccurate capture or mis-entry
of any required information, failures, omissions, interruptions, deletions, or
defects of any phone or cellular phone provider, network computer online
systems, computer equipment, servers, or software, including any injury or
damage to contestant’s or any other person’s computer relating to or resulting
from participation in this Promotion; or the failure to capture any such
information or effects of hackers or failure of any electronic equipment,
computer, phone line or cellular transmissions and/or network connections; all
of which will be disqualified.
In the event
of a dispute as to any entry, registration or submission, the authorized
account holder of the email address used to register, and associated with the
entry will be deemed to be the registrant and s/he must be eligible according
to these Official Rules. The “authorized email account holder” is the natural
person assigned an email address by an Internet access provider, online service
provider or other organization responsible for assigning email addresses for
the domain associated with the submitted address. Proof of being the authorized email account
holder may be required.
By participating and
submitting an entry, contestant agrees that Sponsor and participating parties
are authorized to contact entrant via email or phone to make contestant aware
of information pertinent to the Promotion, and to distribute information
regarding the Sponsor(s) featured products, special events or promotional
offers. Contestants may opt-out of any
further email communication at any time by simply replying REMOVE to any email message, or following the provided opt-out instructions. Any available opt-in opportunities are not required
to enter the Promotion, and checking the opt-in boxes will not improve your
chances of receiving a hat.
By registering and submitting an entry,
you affirm that you have read and accepted these Official Rules. The
laws of the United States apply to and govern this Promotion and any claims
must be raised and resolved in the United States. Any information collected by registering and
entering the Promotion shall be used only in a manner consistent with these
Official Rules and with Administrator’s Privacy Policy. By entering the Promotion,
each contestant agrees that s/he may be contacted, recorded and/or broadcasted
by Sponsor, and that his/her comment, post and/or photo submission may be used,
promoted, released, broadcasted or published by Sponsor in any manner related
to the promotion or advertising of the Promotion.
Sponsor reserves the right, in its sole
discretion, to disqualify any individual (and his or her entry) who tampers or
attempts to tamper with or abuse the entry process or the Promotion website in
any way or who is otherwise in violation of these Official Rules, as determined
by Sponsor or the Promotion Administrator appointed by Sponsor in their sole
discretion. Any questions regarding the
number of entries submitted, eligibility or the authorized account holder who
submitted the entry shall be determined by Sponsor in its sole discretion. ANY
ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY PROMOTION WEBSITE OR UNDERMINE
THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND
CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR
RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE
FULLEST EXTENT PERMITTED BY LAW.
Promotion Determination
& Notification (maximum 1 potential educational Experience recipient)
Experience
Determination – Contest: On or about 4/1/2025, the Promotion Administrator will randomly select
one (1) potential Experience winner from all eligible entries received (eligibility
as outlined above, including having answered all trivia contest questions
correctly) during the Registration Period.

Note: If no eligible
entries are received during the Registration Period, then the Experience shall
not be awarded.
The eligible entrant whose entry is
selected by the Promotion Administrator shall be designated as the potential Experience recipient (see Experience
description below), subject to verification of eligibility, and compliance
with these Official Rules. Only the
entrant whose entry is selected by the Administrator shall be eligible to claim
the Experience. All other entries and submissions received will be
disqualified.
Experience
Recipient Notification: The potential Experience recipient will
be notified either by phone and/or email beginning on or about 4/1/2025. If the Administrator is unsuccessful in its
attempt to reach and speak directly with a selected potential Experience
recipient by phone within 48-hours of the initial notification attempt to the
phone number or email address associated with that contestant’s entry, then
that contestant may be disqualified and an alternate potential contestant may
be selected from among the remaining eligible entries received and notified as
per the procedures outlined above (time
permitting). Note: phone messages will not be left during the Experience recipient
notification process.
During
Experience recipient notification, the selected potential Experience recipient
must confirm their eligibility, and indicate their willingness and ability to
accept the prize. The potential
Experience recipient will then receive official notification via email
delivery, including Experience acceptance documents which must be completed and
returned per the provided instructions and as outlined below. If the selected potential Experience
recipient does not meet the eligibility requirements, or is unable or unwilling
to accept the Experience, elects to decline the Experience or fails to return
the required Experience acceptance documents within the required time frame,
s/he will be disqualified and, at Sponsor’s discretion and time permitting, an
alternate potential Experience recipient will be randomly selected from among
all remaining eligible entries and notified as per the procedures outlined
above. Any disqualified contestant will
not receive any alternate prize substitution or compensation. Decisions
of the Administrator in the selection and determination of the Experience
recipient and all matters relating to this Promotion are final and
binding.
All
of the following will apply to each potential Experience recipient: 1)
recipient will be required to complete and return, within 48-hours of date of receipt, an Experience acceptance form,
including an affidavit of eligibility and a liability/publicity release (where
permitted) and a W-9 form (if prize value exceeds $600) in order to be eligible
to claim the Experience; 2) Experience recipient may be required to present a
copy of a valid driver’s license or government issued photo ID with valid
residential address and a copy of a valid social security card as a condition
of receiving the Experience, and (3) Experience recipient shall be solely
responding for paying all applicable taxes (including, but not limited to, all
local, state and federal taxes) that may be or become due in connection with
their respective Experience, and Experience recipient shall be issued a 1099
form reflecting the value of the Experience.
If any potential Experience recipient fails to comply with these
Official Rules and/or to submit required documentation as requested within the
designated time period, he/she will be automatically disqualified
and the Experience will not be awarded.
Failure
to collect or properly claim any Experience in accordance with these Official
Rules will result in forfeiture of the Experience. If forfeited for any reason, finalist will
not receive any other Experience substitution or compensation, and the Experience
will remain the property of Sponsor and will not be awarded, except as provided
herein.
Educational Experience
Recipient (maximum 1 recipient): The educational Experience recipient shall be
awarded a Wheatley Vodka Educational Experience for the Experience recipient
and one (1) guest (age 21 or older), not to exceed an approximate retail
value (“ARV”) of $2,500, and shall include:

One
(1) educational tour of the Buffalo Trace Distillery in Frankfort, KY for the winner
and one guest (age 21 or older);
o
Date
and time of the tour are as solely designated and determined by Sponsor.
·
A
VIP meet-and-greet with a Buffalo Trace Distillery representative, subject to availability;
·
One
(1) night stay in a standard double-occupancy hotel room in the Louisville, KY
metro area;
o
Hotel
brand, room type, and location as solely designated and determined by Sponsor.
·
One
(1) $1,800 gift card;
o
Gift
card subject to the terms and conditions of the gift card provider policy,
including any expiration;
·
One
(1) $200 Uber account credit;
o
Experience
recipient must have a valid Uber account to accept Uber account credit at the
time of award distribution.
o
Uber
account credit is subject to the terms and conditions of Uber’s account
policies, including any expiration.
NOTE: Experience recipient must complete educational
experience within 6-months of Experience acceptance date.
Experience recipient and guest must be at least
21 years of age and will be required to execute and return a
liability/publicity release prior to accepting and attending the chosen
Experience. Experience recipient must
accept delivery of Experience passes, gift card, and Uber account credit (the “Experience
Components”) in the method as solely determined and designated by Sponsor via
email or digital/mobile delivery, or via physical tickets via shipment delivery
or Will Call. Experience tickets shall be
emailed, delivered or shipped only to the designated Experience
recipient email, mobile number or residential address as submitted during
initial online registration and/or as provided during Experience recipient
notification, via the method as designated by Sponsor. In the event
of shipment delivery, carrier will be as determined and designated by Sponsor
(i.e. UPS, USPS or other Sponsor designated
carrier), or as otherwise specified by Sponsor.
Once emailed, delivered/transferred via
mobile delivery or shipped, Experience Components shall be considered
as awarded and delivered, and Sponsor shall not be responsible for actual
receipt of delivery by Experience recipient. Experience recipient is
solely responsible for any required software application for access to, and use
of, any Experience Components. Sponsor shall not be responsible for
any lost, late, undelivered, misdirected, damaged or stolen delivery; or any
incorrect delivery address or information provided by Experience recipient
during registration or Experience claim. In the event of any
delivery issues, including undelivered, misdirected, lost or stolen deliveries,
Sponsor shall have no responsibility to replace any Experience Components, and Experience
shall not be substituted by Sponsor with any alternate experience or
compensation. Experience recipient shall look solely to designated
shipper/carrier for any lost, damaged, stolen or mis-delivered packages and not
to Sponsor for any delivery issues.
Each ticket and admittance to Experience subject
to the terms and conditions and policy and procedures and rules of conduct of
the Experience and venue, including admittance policy (and any COVID-19 testing
and/or vaccination requirements). Experience recipient and their guest
agree to comply with all applicable Experience and venue regulations in
connection with the Experience. Sponsor and Experience or venue management
reserve the right to remove or deny entry to the Experience recipient and/or
his/her guest who do not comply with requirement polices, engage in a
disruptive manner, or with intent to annoy, abuse, threaten, or harass any
other person at the Experience.
The terms and conditions of the Experience tickets
awarded will govern in the event of any cancellation, postponement,
rescheduling or attendance restriction due to any Force Majeure Event including
weather, pandemic, an Act of God, an act of terrorism, civil disturbance, work
stoppage or any other reason. Sponsor will not be responsible for Experience
date delay, rescheduling, postponement or cancellation due to any
Force Majeure Event or any other event that may cause the cancellation,
rescheduling or postponement of the Experience as scheduled. No
substitute Experience or compensation shall be provided by Sponsor in the event
of any Experience cancellation for any reason.
Experience recipient and guest shall be solely
responsible for their behavior while in attendance at the Experience, must
follow the instructions of Sponsor, policy of the venue/event and directions
from any associated staff or security. If Experience recipient or
guest violates the standards of the venue/event, behaves in an
inappropriate, irresponsible, or offensive manner, or is deemed by
staff or security to have violated any policy of the venue or event, or to be a
security threat in any manner, the Experience recipient and guest shall be
ejected from the venue and event, and shall immediately forfeit the prize
award.
General
Recipient Conditions: No
alcoholic beverage is part of any award. Award recipients
must accept delivery of award in the method as solely determined and designated
by Sponsor. All other costs and expenses
related to award acceptance, delivery, redemption or use not specified herein
as being provided are the sole responsibility of recipient. All income, federal, state and local taxes are
the recipient’s sole responsibility. All
awards are non-transferable and no cash redemption or award
substitution allowed, except at Sponsor’s sole discretion or as provided
herein. Sponsor reserves the right to
substitute award with one of comparable or greater value, at its sole
discretion. All hats and experiences are awarded as
is, without any warranty, express or implied, by Sponsor. Failure to collect or properly claim award in
accordance with these rules will result in forfeiture of the award. If forfeited for any reason, participant will
not receive any other award substitution or compensation, and the award will remain the property of Sponsor and will not be
awarded, except as provided herein. All properly claimed awards will be awarded. Any unclaimed awards will not be awarded. Total ARV of all available Promotion
awards: $2,500.
Additional Rules &
Restrictions: By participating, entrants agree to
abide by and be bound by the Official Rules and the decisions of the Sponsor
and Administrator, which shall be final in all matters relating to this Promotion. In the event an entrant is awarded the educational
experience, and is later found to be in violation of
these rules he/she will be required to forfeit the award or to reimburse
Sponsor for the stated value of the award if such violation is discovered after
recipient has used the award. Participation in Promotion constitutes permission
for the Sponsor and its designees to use entrants’ names, cities and states of
residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide on
perpetuity without limitation or further compensation, notification or
permission, unless prohibited by law.
False, fraudulent or deceptive entries or acts shall render entrants ineligible for any award.
By
participating, entrants agree to hold all Released Parties harmless from any
claims, losses, actions, or damages of any kind, whether actual, incidental or
consequential, for injury (including but not limited to death), damages, losses
or expenses arising out of or relating to entrant’s participation in this Promotion,
or the acceptance, possession or use/misuse of any award, or participation in award-related
activities (including but not limited to travel or activity related thereto),
and to assume all liability therefor.
Participants
are restricted to use of ordinary and typical computer equipment, mobile phone
equipment, Internet access and cellular networks. Sponsor disclaims all
liability for the inability of a participant to complete or continue an entry
due to equipment malfunction, busy lines, inadvertent disconnections, acts
beyond the Sponsor’s control, or otherwise. The Sponsor disclaims any liability
for entries not received due to technical difficulties or transmission errors.
The Sponsor disclaims all liability for any delays, mis-delivery, loss, or
failure in the delivery of any item sent by mail, courier, express, electronic
transmission, or other delivery method.
Released Parties are not responsible for mechanical, technical,
electronic, communications, telephone, computer, hardware or software errors,
malfunctions or failures of any kind, including: failed, incomplete, garbled or
delayed transmission of online entries, traffic congestion on telephone lines,
the Internet or at any website or lost or unavailable network connections which
may limit an online entrant's ability to participate in the Promotion, and any
injury or damage to entrant’s or any other person’s computer or mobile phone
related to or resulting from participating in or downloading any information
necessary to participate in the Promotion.
Released Parties are not responsible for any other errors of any kind,
whether computer, technical, typographical, printing, human or otherwise,
relating to or in connection with the Promotion, including, without
limitations, errors which may occur in connection with the printing or
advertising of this Promotion, administration or execution of the Promotion,
the cancellation of the game, the processing of entries or in the announcement
of the Experience or Experience recipient.
Sponsor, in its sole discretion, reserves the right to disqualify any
person tampering with the entry process or the operation of the Promotion
website.
Sponsor
reserves the right to cancel, modify, reschedule or terminate the Promotion for
any reason including, but not limited to acts of God, pandemics, force majeure,
government regulatory action or ruling,
fraud, misconduct, or if any technical failures destroy or threaten the
integrity of the Promotion, in the opinion of the Sponsor/Administrator, or if
a computer virus, bug, or other technical problem corrupts the administration,
security, or proper conduct of the Promotion as determined by Sponsor/Administrator,
in their sole discretion. In the event of early termination of the Promotion,
Sponsor reserves the right to determine the Experience recipient from among all
eligible, non-suspect entries received as of the time/date of such termination.
IN CASE OF DISPUTES: By
participating, each entrant agrees that (1) any and all disputes, claims, and
causes of action arising out of or in connection with this Promotion, or any hats
awarded, shall be resolved individually, without resort to any form of class
action, and any judicial proceeding shall take place in a federal or state
court within the State of New Jersey; (2) any and all claims, judgments, and
awards shall be limited to actual out-of-pocket costs incurred, including costs
associated with entering this Promotion, and in no event will entrant be
entitled to received attorneys' fees or other legal costs; and (3) under no
circumstances will entrant be permitted to obtain awards for, and entrant hereby
waives all rights to claim, punitive, incidental, and consequential damages,
and any other damages, other than for actual out-of-pocket expenses, and any
and all rights to have damages multiplied or otherwise increased. All issues
and questions concerning the construction, validity, interpretation and
enforceability of these Official Rules, or the rights and obligations of
entrant and Sponsor in connection with this Promotion, shall be governed by,
and construed in accordance with the laws of the State of New Jersey, without
giving effect to any choice of law or conflict of law rules or provisions
(whether of the State of New Jersey or any other jurisdiction), that would
cause the application of the laws of any jurisdiction other than the State of
New Jersey.
Odds: Odds
of being selected as an educational experience recipient are dependent on the
total number of eligible entries received during the Experience Registration
Period and the skill of the entrant in the trivia game completion.
